Am I responsible for this guys bindings breaking?

Skied whiteface today. There’s a large park jump towards the bottom of the mountain. It gets really crowded at the drop in and It’s always a fight to not get snaked. Finally my turn to drop, nobody showing symbols of an obstructed landing or anything, nobody up top even knew a guy had crashed.

Drop in, nice 180 safety, landed switch directly on top of some guys marker griffons. They completely fucking obliterated. Immediately I was struck with how many things went wrong for that to happen and how fucking unlucky that was. We exchanged contact information like it was fucking car accident to see if the warranty went through. In the moment I made the mistake to offer some money up if the warranty didn’t go through. Now he’s in my messages tryna talk to my parents and shit.

Heres the text convo (AITA)

If I’m not able to get the bindings warrantied, can I get one of your parents phone numbers please

Me:
Try and get it warrantied first, i’m sure you can manipulate your way around evos warranties.

I will do that, but I at least need either your last name or one of your parents’ phone numbers to keep you accountable

My parents don’t want anything to do with this.

Understandable but if evo won’t warranty them I need some way to know that you can pay me for part of the binding price


I’m almost positive that I’ll be able to get them warrantied, but I need some sort of insurance

It really fucking sucks to be put in this situation. In all honesty i don’t have $150 to send you, i’m 16. I can throw money at you in condolences but I shouldn’t have to be held responsible for this.

If someone had crossed there poles or shown any indication of something in the landing this wouldn’t have happened.

Let me know how the warranty goes I don’t have any insurance to give you, sorry that i’m not a man of my word.

You or whoever you were with could have hollered to someone else 30 feet uphill from you to not get people to not jump. You, if you knew park etiquette, could have made an X, hollered, or shown literally any sign that there was a ski in the landing.

What am i gonna say to your face, “no i’m not paying for that shit”. I’m a pussy for not saying it to your face honestly. I get your frustration, and how you would want someone to pay for that loss, but a catastrophic accident is still an accident.

This is a shitty situation, and literally everything that could have gone wrong went wrong.

Once again i’m 16, and i think that should be an automatic turn off for you to ask for money from me.

Please let me know how the warranty goes, I want this to end in good faith.

You usually gotta watch the guy dropping ahead of you. How else are you going to know it’s clear?

If you fall, you can’t be expected to run all the way up the landing to let everyone know. Sounds like you went before he even had a chance to get his stuff. I’d kick him $50 and call it a day.

Technically, you owe him nothing but it sounds like you might have jumped the gun a bit.

I dropped right after another person hit the same jump, he had landed past the skis and presumably skied away, still had no idea something was wrong. This guy had plenty of time to go grab his ski and he wasn’t even walking to get it by the time I was at the bottom of the jump.

I wanna think that nobody is at fault and that it was just bad timing, but I guess it could be me. I could have been more vigilant before I made the call to drop.

Cant really prove a point cause i don’t even know his side of the story. Still frustrating as fuck and i feel guilty as shit.

It's reasons like this I feel terrain parks should have attendants on large jumps with green / red flags to open and close the features. Similar to how waterpark attendants control traffic down waterslides. It's always a good idea to have a friend / filmer / coach on the knuckle to act as a spotter and close a jump when this happens. This would be an interesting legal situation if the binding guy had been seriously injured to see how that would be ruled and who would be at fault. Ultimately, all though it can be hard to do all the time, the parksmart rule 'know your landings are clear' comes into play here, in which you did not know whether your landing was clear or not. Shitty situation for everyone involved. All in all I would say you do not owe him new bindings, but depending on your financial situation you could be a homie and help him out.

Sometimes shit happens and is just an accident. There doesn’t always have to be recompense for such things.

I got hit by a snowboarder in 2011 and got a concussion and my C1 twisted about 20 degrees under my skull. I’ve spent probably $15k on doctor appointments, X-rays, MRIs, PT, etc and am still dealing with the effects. Try to help this guy out if you can and be thankful that it was such a minor thing with relatively low cost.

Also, did the heal piece just come off or it is totally broken? Looks like the brake is toast for sure but those are cheap too.

Op you don't owe this guy shit. His gear was left there after another skier went down the same jump. That plus people below not giving an X should have been enough explanation for you to proceed. If he was laying there and you hit him, that'd be another story.

Tell him to get fucked and sue you if he wants. Tell him he will pay 10x in legal fees than those trash ass bindings even cost. Are there witnesses to either side of the story? I can't imagine the law would side with someone leaving their shit on the side of a ski hill. How long after he fell was his shit still there? If we are talking 5+ minutes then he can fuck off. Shit he's probably lucky you didn't fall and get hurt. This is a tricky one for sure.

I'm not a lawyer so this isn't legal advice. It is a bitch and a half of inconvenience to take someone to small claims court, especially over $50 with your only evidence being hearsay. Sure he wouldn't pay legal fees, but only if he wins, otherwise it's on him. This dude can't be that stupid to risk hundreds of dollars just to recoup a cheap ass binding. He should have claimed warranty and left out the part about you landing on them. If you don't plan on paying for them, you should definitely stop messaging this kid immediately. You might have already implicated yourself at fault in the last 2 messages.

Just do what big corporations do and call his bluff. My one apartment company did this to me in a pretty clear cut case over about $300-600 for late return of security deposit but it woulda required me to take off work and file all sorts of paperwork with the courts. I thought about doing it just out of spite but eventually said it wasn't worth my time. Same shit happens with traffic violations; they assume you don't give a shit to go to court most times.

This kid sounds entitled and a whiny bitch.

Not the asshole here. you're 16 and it was an accident. Technically, if his skis were in the landing he should have run up to where people could see him, indicated that the jump was closed, grabbed the skis, indicated that the jump was open. At least that's how I see it.

Shit happens all the time, you're not responsible for his gear being replaced. You had no way of knowing in good faith that his ski was there and he wasn't doing shit about it. He's an "adult" but that doesn't mean shit. I meet people 20 years older than me that behave like children or are a piece of shit. He's trying to hardball your parents for some $6 markers because he's a gaper and doesn't understand jump etiquette. Next time he falls in a landing, this will get his ass in gear to get his shit out of the way

I would end it there. Avoid being hostel. Block his number if he wont leave you alone. Def don't give him your last name or any other info.

It sucks but shit happens. If you had been bombing some hill switch and skied into him or something sure. But noone got hurt, sucks the binding is fucked but thats how it goes.

He's lazy so he doesn't deserve a cent. They could have cracked when he crashed. If his ski came to rest where you landed he might just be a bad skier that crashes regularly. Shit he might have felt them crack and left them on the slope hoping someone would finish them off so he could get a new pair. Did he ever ask if your ski was okay?

Looking at the new york skier safety act and damaged equipment is not mentioned. Seems to only care about personal injury.

under 18-105 duties of skiers it states ‘2. Not to ski beyond their limits or ability to overcome variations in slope, trail configuration and surface or subsurface conditions which may be caused or altered by weather, slope or trail maintenance work by the ski area operator, or skier use’

i think the argument that they were in over their head and not abiding by this provision of the law is there. Plus the fact that you did not act with ill intent or maliciously really makes me think your not at fault and thats how the court would feel as well.

Don’t give him your parents numbers. Tell him to piss off, to me it’s clear he had 0 idea what he was doing in the park and he’s at fault for not notifying everyone above the jump that someone was in the landing. Get out of the park or get out of the way, you don’t have to pay for shit.

I had a kid break my bindings once in a similar way except he told me to talk to his dad and his dad was chill and got me new bindings. if some 16 year old landed on my ski the thought wouldn't even cross my mind to make him pay for it (i guess unless he did something seriously stupid and egregious)

it's too bad for the guy but OP i don't think you owe him money unless you're spinning the story in your favor, but judging by what you've said i kinda doubt that. i know it's uncomfortable (that means you're a decent dude and care) but sometimes unfortunate things happen and no one owes anyone anything. and honestly i kinda see this as a risk you take by choosing to enter the park

if i were you i'd just say look man i'm sorry about what happened but i don't think i owe you anything and i'm 16, i don't have anything to give you. hopefully the adult part of his brain kicks in and he stops messaging you about it

Park etiquette exists for a reason, you can't see the landing of jumps, and if you called your drop and had good reason to believe the landing is clear (acting in good faith), you did nothing wrong here. From my interpretation, both Park Smart and the Skier Responsibility code are on your side here too, as you were skiing in control, hitting features correctly and within your skill level, and doing your best to look that the landing was clear. It sounds like he was way over his head here and didn't know how parks work at all.

Its completely unreasonable for this guy to pin all the blame on you. I really do believe parks should be open to everyone, but people who never bother to learn how use the park without putting others at risk are a danger to everyone

Bummer situation all around. Respect to you for trying to be nice and help him out, sorry it's backfiring on you like this.

Not sure how you'd be at fault when he completely failed to indicate an obstruction in the landing. He didn't signal the jump was closed. He waited to go get his ski. Somebody else cleared the jump with zero indication of any issues between his crash and your drop. Everything points to the jump being clear. The only possible indicator is that he didn't ski away, but it sounds like he was chilling at/near the bottom the whole time you were waiting to drop and hitting the jump, which means he's out of the way and you're good to go. Complete lack of park etiquette from him.

Seen sunnies and helmets get dropped in landings before, and every time the rider (or someone nearby) immediately signals the X, grabs their gear, and gives the O once they're out of the way. That's the rider's responsibility, because it was their mistake in the first place. Same here. His mistake, his failure to signal (plus waiting for whatever reason), his responsibility if his gear gets hit.

You don't owe this guy your parents' phone number. You (or your parents) don't owe this guy money. It sounds like you feel guilty and genuinely want to help him out, but this is on him. The most that can be expected of you here is a "Sorry this happened, you should get in touch with Marker and see if they'll help you out", and even that's a courtesy.

It's not the most honorable thing to do, but I'd seriously consider blocking him now. Especially if Marker tells him to get lost, because then he'll come after you pissed off. Best to leave this situation where it's at right now.

Dude was skiing beyond his ability and assumes the risk of breaking a ski when he enters the park. Whether you landed on his ski or not, it's his own fault his binding is broken.

Instead of owning his mistake, he's making legal threats to a kid to try to bully him into making his parents pay for his mistake... pathetic.

Don't let that weiner posture over you, block and don't look back. Don't even give him a chance to respond cuz it's always when you're trying to help when you dig yourself deeper into the hole lol.

Can’t totally tell from the picture but it could just be a $15 brake that needs to be replaced and the heel piece could have just slid off the plate. If the heel piece itself blew up then just find one heel piece somewhere on the internet, couldn’t be that hard for the guy.
