Replying to K2 ski boot issue (130 Pinnacle)

Having an issue here and need some advice:

Bought these on eBay around 2/2015 and love them. Took them into a boot fitter recently to get custom foot beds. Came back to pick them up and the guy somehow ripped/cracked the ankle piece from the walk mode switch to the circular piece on the side of the boot.

I emailed the eBay seller to get his take though would like some NS advice on how to proceed.

Can they be sent back under warranty? Should I have the boot fitter address the issue?
