Technically speaking, the parking lot is still considered Pizza Hut's property so if it wasn't kept up to par, i.e. pot holes, cracks, ice, etc and she did hurt herself enough because of it, it is their fault. Stupid, I know but it's how they operate.
To OP and everyone else, even for such a small fender bender like this, call the cops. Get a police report because that's your first line of defense in bullshit cases like these. If she was legit hurt, it would've been in the report and this suit wouldn't be an issue right now.
I got into an accident years ago because of ice. The highway was just covered in a sheet of it and cars were all over the place. I did a few 360s and finally hit the guardrail that put me to a stop. A girl very far behind me got scared from seeing me sliding, slammed on her brakes and went skidding all over the place, resulting in her slamming into the back of my Jeep. Long story short, her insurance company tried suing me saying that it was my fault she got into an accident and tried suing me for the damages to her car which were in excess of what her car was even worth (POS dodge neon). My saving grace was the police report.
Anyways OP, get a lawyer if you can and fight it. For her to claim loss of wages and whatnot, she needs to have a ton of paperwork from the doctors and her employer. This sounds fishy. Good luck!
