The kids are in your duty of care and you're taking advantage of them and undermining the whole profession of teaching. I've had people ask shit like "oh you're becoming a teacher, you must looking at little kids then" when I told them I'm studying bachelor of education and I take alot of offence to that as I want to help under privileged kids gain the best education and when people make stereotypes that teachers are only in for the attraction of kids it puts me off becoming a teacher.

17 is above the age of consent in the vast majority of the world. Hell it's legal for people under the age of 23 to have sex with 17 year olds in Florida, where this took place.
I'm not saying there is no wrongdoing here, she's a teacher and has a moral duty not to do something so obviously inappropriate with her students. She should for sure lose her job and never be allowed to be in a position of influence over minors again, but realistically that's where it should stop, perhaps a short sentence.
There is no evidence anywhere in that article that she is in any sense a rapist. Partly this is a problem with the definition of rape/statuatory rape in the US. Rape means forcibly having sex with another individual without consent. Fine, makes sense up to this point. But the idea that a 17 year old, boy or girl, is incapable of consenting to sex is ludicrous.

Do you really feel having sex with an attractive 30 year old woman or man would have caused you long term mental/physical damage? I sure as hell would have managed. I had a girlfriend a fair bit older (though not 30) and more experienced than me, when I was that age (totally legal where I'm from) and I certainly don't feel damaged. The idea that was rape is ridiculous. A legal system where a 17 year old 'consents' to sex, yet this is somehow considered rape, because he/she is supposedly incapable of doing so, is laughable.
I do understand that it's the law, but it's a stupid law, and as a result, there are men and women rotting in jail, branded as rapists/paedophiles, for doing stupid but not unforgivable things, because of what is essentially, human instinct. FBGMI don't understand why it is assumed that because the venue of the conversation is the internet, the conversation is somehow less substantial. the internet doesn't degrade the content or the interaction...it's just a different medium. If you're under the impression that the only times the use of proper grammar is appropriate/necessary is in formal situations, such as when you're actually teaching it to someone else (your students, for example), then there's really no reason to use it at all. By that standard proper grammar is not at all necessary and you're implying that any one of us you interact with on the internet is undeserving of your efforts. And by that standard you wouldn't even be partaking in an internet forum in the first place. It's not like it takes a whole lot of effort.
I understand that you're not trying to impress anyone on the internet like you would be on a job application, or a resume, or something of that nature, but I don't understand why all "real life" customs go out the window whenever somebody voices their opinion on the internet.

elindeA 17 year old can certainly give consent. Perhaps not legally, but I believe the law is flawed. We can't assume that these kids truly wanted to have sex with this woman, but logic tells me they probably did. I don't believe this woman overpowered them or tricked their young, innocent minds into sexual acts; she probably didn't take advantage of them. My definition of rape (which I suppose isn't exactly the law's) is that rape is when one forces him/herself upon another without the permission of the other. If a kid can't use his brain to make an measured decision, its the kid's fault. However weird it may be, if both parties are having a great time doing it and no one is being injured, it does not deserve a 22 year prison sentence.
PS: In this case, the gender of those accused should play a role. A man is much more likely and able to take advantage of a young girl than a woman.

I'm not expert on psychology however I think it comes down to basic human instinct where we are sexually attracted to those who have power. In this case the teacher, so it doesn't matter if she pressured, coerced, or any other means to have sex with them, she still has that basic power to have sex with them. This is the same principal that applies to all jobs where someone has power over someone, not just a teacher.
But if we allow this young, semi attractive teacher to fuck students, then who's to say the crusty old man who fucks a 17 year old girl is no different and shouldn't be punished? If you took the teacher situation and a 17 year old fucked a 22 year old he met at the gym, it probably wouldn't be an issue that makes headlines if he presses charges. However, teachers are held to a higher standard and have a duty of care to these kids. When they go abusing this duty of care then they should feel the full force of the law because it undermines the whole profession of teaching.
And to your last point, the sex of the offender doesn't matter. Rape is rape, and should be punished as such. And with regards to your point of men being more likely to coerce a female student into sex, a study done by the US department of Education, found 4.5 million students felt some form of sexual conduct by their teachers and females made up 43% of cases.

elindeThis is not something we should be arguing about. By a legal standpoint you're correct, but legality is somewhat bullshit. I think if a crusty old man fucks a 17 year old girl he is definitely creepy but if the girl had no problem with it than it's totally fine. The sex of the offender definitely does matter simply because society dictates it is so. Throughout history men have been raping women, and the opposite has generally been quite rare. Sure, that 57% might have experienced sexual conduct from their teachers, but if they truly cannot defend themselves from a woman seducing them (even though I imagine most would enjoy it) than they do not deserve protection. And yeah, I think the same should apply for female students, it's just a little more socially sensitive because of all the sexual abuse women take in educational institutions and in the wider world.
I hold that rape should be a physical concept, not a mental one. If someone agrees to sex and later regrets it, no one should be punished for doing something he/she truly believed was okay in both party's eyes. This obviously leads to grey area as we've seen in these cases of rapes in universities, but it still should apply that saying no is the individual's responsibility. This is not the current situation, but as I said, I don't agree with everything the law says.
The bottom line is that if I had sex with my teacher and we were both more than willing to participate, no one should go to jail. If you feel that if you had sex with your professor it was rape, you are a very strange teenage boy.

When with my class mates and this topic comes out and we discuss it. It's something that everyone can agree on that teachers who have sex with students should feel the full force of the law. I haven't met a single student at uni that thinks a teacher having sex with a student is okay.

I don't think it's the kids pressing these charges but the parents and good on those parents. Up until 18 a parent has the final say, so if a parent wishes to press charges then they should. Parents send their kid(s) to school to get an education and trust the educators. A parent doesn't want their kid(s) to have sex with their teachers.
I had a teacher at my old school have sex or something with a student and everyone in the school knew about it and no one really cared, and then one day the media got a hold of it and it made city news. All the students didn't care, but the parents were outraged.
If we only counted rapes where the perpetrator physically over powered their victim then most rapes wouldn't actually be considered rape. If you coerce, pressure, drug a person to have sex with you, you're a rapist. If the person you're having sex with is drunk then you're a rapist. (This point is rather vague as it's a super muggy area, that's just a broad statement about drunk sex and not everyone who has drunk sex is a rapist).

I think the whole concept of taking the word of law literally down to tiny nuances in grammar in this country's legal system is fucking stupid and leaves way too much room for loopholes and cases like this one. Do you really think that if this had all taken place 365 days later that they would have all been immensely more capable of deciding whether or not to have sex with this teacher? Just because someone is under 18 shouldn't necessarily mean it's rape. What if it's the day before their 18th birthday/the day before they reach the age of consent in that state? Does that one day make all the difference in their mental capacity to give consent? Also, I think the whole "if one of them is in a position of power over the other, it's rape" thing is a very slippery slope. What if two adults, fully sober, have consensual sex, but the guy is a massive, super strong body builder guy and the girl is small? Technically wouldn't he have power over her because he's bigger than her? Or what about someone wanting to have sex with someone who's very rich and holds a public office? There are endless examples of people having sex with people in a position of power over them, that doesn't necessarily make it rape.

If a 22 year old fucked a 17 year old outside of school I wouldn't care. But teachers are held to a higher standard in society, adults trust teachers with their kids and when stories like this arise it breaks the trust between teacher, student and adult. Like I've said, I'm studying to become a teacher and help under privileged kids, and when cases like this do come up it creates a stereotype that teachers only become teachers to fuck their students. Final point. To her sentence, it appears as if the purpose of punishment isn't rehabilitation, retribution or incapacitation. It appears to be a general deterrence and she is being made an example of for other teachers who are thinking of having sex with their students.

erikKFuck you. Seventeen year olds are capable of making their own decisions. What ever happened to taking responsibility for your own actions?
