KneeDropparaphrasing, but: "features..change due to weather, snow conditions..time of day".
op said this is what happened.
to prove negligence(sp?), you would have to prove they knew about it beforehand.
sounds like they took care of it as soon as they were aware of it.
No not at all. If a screw comes loose in a box and somebody and their skis get smoked the mountain didn't have to know to be liable.
pow_pow~Mate those signs have no legal basis what so ever, this has been pointed out by me and a few others in this thread who have worked for mountain ops on a hill. If you have no knowledge of the law or of area liability seriously just stop commenting, you are sounding like a 12 year old because you are biased and just flat out wrong.
op has posted pictures. he's not suing the resort. he wants a new jacket which is completely fair. seriously you guys just all hop on the bandwagon and come off sounding like retards without backing up any of your opinions whatsoever.
THIS SO FUCKING MUCH. Jesus christ people. OP never said anything about suing. said he wsn't suing if anything, just wants a jacket. People have gotten new gear for all kinds of stuff, 1 drop of oily water from the lift on a rainy day, screw out of boxes, and whatever else. IT depends on the place and time.
KneeDrophow am i biased? because i dont want our parks taken away due to entitled, sue-happy shitheads?
to continue my paraphrasing: "it is your responsibility to inspect before use and throughout the day"..
it just word for word telling op to shut the fuck up.
would he win a lawsuit/get his jacket back if he hired a lawyer? maybe
would that make him a shitty person? imo, absolutely.
I do not know what this setup looked like with this stake. But if there was a big piece of metal sticking up that ripped op's jacket it's fine to be pissed. How that makes him sue happy for wanting him replace idk(it doesn't you're just being fucking retarded).
Idk what financial situation you or your family is from. Let's say you don't have a lot of money. You work your ass off washing dishes or something similar all summer to go toward skiing. This money buys you a season pass, a new jacket since your old one no longer fits, maybe some skis, whatever. You're having a good old time shredding the park and then you land on a big piece of metal in the landing. Not even a random piece that just happened to get there but something that had been known to be there but since it wasn't in the intended landing area wasn't considered a proble Your jacket that you cleaned a zillion dirty dishes to afford is ripper, your back hurts, and you're super bummed. The people at the mountain basically say LOL, sucks to suck, too fucking bad bro, cry me a river, etc. You might be a little pissed and want a new jacket.
Like I said Idk what the stake looked like, exactly what went down, just that there are definitely scenarios where OP isn't being a "sue happy bitch" for trying to get a new jacket.
I've worked at ski area's for 13 seasons, 10 in the park. I'm not a lawyer, but I know a little bit about the mountains. I also know that whether people agree or disagree with OP getting a new jacket, a ton of people in this thread that are ganging up on him are just being ignorant douchebags. Yeah! 12 other people tore OP down YEah! I'm gonna do the same YEah!
I'm always scared of lawsuits. I don't want to see people get hurt, I don't want to end up in a courtroom ever over this stuff, I don't want any parks to get shut down or scaled back over lawsuits(see salvini case and removal of jumps) and I sure as fuck don't want to lose my ability to be creative in park building because of insurance mandated regulations. That said I don't see why everyone in this thread is being such a douche.
