Replying to Injured because of hills fault?
Skiing my home mountain, we have a pretty crappy park but its still fun to dink around while the snow is like mid april here in the west. There was a large wallride/ A frame set up and I went to slide the very top had to much speed and ended up falling over the back side of the wallride, I came down on my back to a metal post sticking about a foot out of the snow. ( I believe its a stake to keep the wallride in place but because of the warm weather this post has been exposed from melting snow)
It was about a 10-12 foot drop from the top and it just missed my spine. I was in extreme pain was able to ski to the patrol cabin where I waiting for an ambulance to take me for xrays and what not. Luckily nothing was broken but im left with the biggest back bruise I could imagine and I'm done skiing for at least a month.
I went to speak to the hill manager to explain that this was not my fault im injured, the hill employs 2 park staff to keep up with maintenance, He came back to say the wallride isn't meant to be hit on the other side and its my fault. My new patagucci jacket is ripped, I think thats easy to say that needs to be replaced. If that post hadn't been sticking a foot out of the snow I would have fallen over the back side and hit the snow and got up and tried it again. I can post photos of this wallride if need be.
What do you think is fair compensation for this accident?
