If this is legitimate I would think it would be hilarious if redbull came out with a $15 product that is just a pair of cheap fake wings(made out of a couple metal coat hangers and fabric) with a redbull logo on it, and just sent that to everyone as payment of their $15 redbull product.

Red bull gave people false hope. Increased focus and energy? How are they going to say that without scientific proof? Yes the world is full of not so bright people who will believe anything. Yes that is their fault. For example,companies aren't allowed to lie about nutrition facts. But, if they could, you would want to leave it up the consumer to believe a product is protein filled when it's not? Or lie about not having peanuts and then someone dies?

Im with you. Its such bullshit. I hate the sue culture. Something seems wrong, lemme sue to find out. No shit it doesn't give you wings. And anyone who has tried to drink any energry drink and do something athletic found out the hardway it doesnt work. Bad on you, good on the company.

It just feels idiotic that a company can be sued for their fucking slogan. Same shit happened with Papa Johns and the "Better ingredients better pizza" thus the term "puffery"

Disclaimer, Haven't really looked in to this

But fairly sure the lawsuit was more about their claims that the drink would offer improvered concentration, energy, and physical performance shit rather than the fact that Ito didn't give you physical wings.

i found this pretty fucking thick, considering most adds on television always had the small speedy voice saying "redbull will not give you wings, it will improve alertness in body and mind" or whatever mumbojumbo. people really have nothing to do with their spare time.

Anyone who files a claim has given up ANY right to complain if Red Bull has to reduce its' funding of any action sports commitments that it makes. As a company that has done SO much for the sport of skiing, among many other non-mainstream sports, these lawsuits are damaging. The losses will impact budgets and will have effects somewhere and marketing budgets are often the easiest places to reduce expenses.

Hope your free cans of Red Bull are worth it...

for what it is worth 13mill is .18% of what they are worth.

It definitely is ridiculous I will agree, but if I was a company in this position would do something funny from this point forward. Instead of the tab having a bull on it maybe it should just have a set of wings or something just to shut those few ignorant people up.


If I worked for red bull, and a customer asked me why they did not magically sprout wings after drinking a can. I can honestly say I would probably laugh thinking they have to be joking.

Good point, I hadn't thought about this. It's an interesting dilemma for skiers, though - mooch off a company that does a ton for your industry? Or get free product that you like?

...was gonna claim, not anymore. It's probably healthier not to anyway.

Thank you for proving my point with regards to greed within our culture. By your reasoning it is okay to cash in on large companies where no true damages have occurred simply because "they'll be fine."

Also, the $13 settlement on the class action lawsuit is absolutely positive.

not that i'd expect an ad major to be interested in facts or reading, but im pretty sure the case is about the false claims of increased focus etc than it is about the wings part

jesus, you sound like the people who swallow the PR spin responsible for the popular myth that the woman who sued mcdonald's for the hot coffee burns was a frivolous lawsuit.

this 13 million sum will have no noticeable effect on red bull's ADVERTISING in the sports world. advertising works. that is why it's a 100+ billion a year industry. there should be rules governing it, and punishments handed out when they break the rules. i won't be making a claim/getting a refund but you folks feeling sorry for red bull here are delusional

Yes, $13 million is a small number in the grand scheme of Red Bull, but you are delusional if you believe that figure will absolutely be offset by something within their budgets, whether it be a decrease in marketing spend or some other format.

I'm all for holding companies responsible when actual damages occur and parties are truly taken advantage of (Liebeck v. McDonalds is a good example of this), but a frivolous claim like the one brought about in the Red Bull class action lawsuit serves no one positively other than attorneys.

it's less about protecting stupidity/rewarding the customers that were "duped" and more about punishing the company for doing something against the rules. where would you rather the pay out go?

just to be sure we're clear, the suit is about the claims of increased concentration and shit (the people thinking this court case was actually about wings are retards). but oops, people are misled about this because of false notions being propagated through the media (e.g. sloppy journalism and misleading headlines about wings). it's almost as if misinformation can lead to problems....

why should a company that is misrepresenting their product not be punished? i don't see what alternative there is.

don't feel bad for red bull. they fund some things you like because it makes them more money in the future and in this case they are paying out a tiny fraction of what they make because they broke the rules.

i don't see why you guys seem to want a precedent set where we don't hold companies accountable for claims made in mass media

Cash in? 15 dollars of free red bull (if this was true) is not exactly cashing in. They give away so much free red bull out! They send a free red bull with every chegg order. Thousands of free red bull.. Once again, they're going to be ok.

The claim stems from the basis that the product gives no more performance boost than a cup of coffee or an alternate source of equivalent caffeine that is available for purchase at a lesser price, something that to the best of my knowledge was never alleged by Red Bull. The lawsuit is a crock of shit basically.

I have not purchased a Red Bull or other such energy drink product in at least six years and have no skin in the game. I just find the opportunistic nature of our society to be pathetic.

theyve also claimed taurine has benefits that authorities couldnt find evidence for. that's just what i happen to know
