There is a huge difference between Nazi Germany or the Segregated south and a modern day "civil rights act-less society." Nazi Germany had racism based policies and laws, the government itself is where racism and every negative aspect that it led to came from, it didnt come from a lack of regulating the people.
Its was a very similar deal with the south, slavery was legal, the laws and government itself were racist.
Your examples are of a society where racism was a policy, not a society completely free from any racist policy.
Its the government that cannot be allowed to discriminate, every person regardless or race, sex, religion, etc. needs to be treated equal. But to say that the government should regulate how its citizens think and interact with each other, needs to force private people and businesses to serve someone they dont want to serve, etc. sounds more like Nazi Germany to me.
The government has no authority to infringe on private property owners rights to use their property as they please. Its a huge violation of our private property rights, a very basic and crucial right to a free country. that and forcing companies to hire based on race, meet "racial quotas" is also a violation of our rights and if anything encourages more racial tension. the fact that businesses have to meet these racial quota's and are at a much greater risk when firing a black/minority vs. a white person, sounds like the definition of inequality.
