"prosecution cant prove mens rea(?) then the defendant cant be convicted guilty" its not black and white all the time, no video of him doing it O no proof you can go. A lot of the time things are implied and guess are made based on evidence.

People believe bad people shouldn't be punished but rehabilitated.. I believe they should be punished and rehabilitated... How can you rehabilitate someone if they know they can get away with it?

I hightly doubt hes going to learn much about right and wrong in a $500k/year therapy ocean villa.

Send him to the fucking slums of the dirtiest part of a 3rd world country and make him work his ass off there and barely be able to scrape by. Teach him that happiness isnt being wealthy and that gratification isnt happiness. Maybe then he would learn something more than having some overlypaid person tell him his actions were wrong and that living in a ocean villa isnt happiness.

Hey who fucking cares if this fuck nugget goes to jail or not, the little pussy has to live the rest of his life knowing he killed 4 innocent ppl bcuz he was drunk of his wagon, any logical person would kill themselves if you were in his situation, so if he doesn't kill himself in the next little while, the kid needs to go to a mental institution and get locked up for life because he is fucked in the head.

Your analogy is awful as well because the consequences of not paying for train ticket is the trains being slightly more expensive to run, the consequences of a dui is killing people, one is a little bit more serious

also you admitted to driving drunk before, if you hit someone would you still think 20 years in person is an good punishment?

The defence suggested has suggested that he attends that therapy centre, but currently he is staying at the juvenile detention centre till they decide how to move forward. Even if he does go there the therapy centre is a private house offering one on one therapy not some hotel. Think about how much a therapists makes in a year, double that(there for two years) and then see how much is left for living expensiveness


I hate how biased this article is trying to spin every little thing to make it look like he is getting off easy

And for all the people saying "Oh, he has to live with this for the rest of his life, that's plenty of punishment." No it isn't. Maybe you'd feel that guilty, but there are plenty of selfish assholes out there, this kid included, that wouldn't. It's already been "proven" by the defense that he doesn't know right from wrong and has a lack of empathy, so the real question is, why WOULD he feel guilty about it?

I wouldn't be surprised, at all, if what has been going through his mind is "it's not my fault they drive a piece of shit car that put them in that place in time in the first place"

too bad there were no survivors besides him that I know of. A similar story happened in Texas--sort of, except a drunk driver killed a mans kids who were pushing his car. The father then shot and killed the drunk driver---no charges were ever filed. TEXAS!

Texas--doesn't ALWAYS suck...

THAT'S BADASS. Im usually very against vigilante justice and all for due process, but I could see myself doing the same thing if I KNEW FOR A FACT the guy was drunk. Drunk drivers are the scourge of the Earth because they never injure themselves, only others. Something about how all your muscles are limp when you're drunk so you don't sustain as much damage to your frame as someone who is aware of the impending crash and tensing up.

It's the same reason one of dad's friend's kids was uninjured when he fell asleep at the wheel and rammed his car into a telephone pole going 45. He was asleep, so all his muscles were relaxed.

drunk drivers are the worst. and stupidity does not protect yourself of punishment.

i cant go to another country, like an islamic one and drink alcohol in public or kiss my girlfriend on the main square and act all surprised. its ones job to read what is fucking legal and what not. if youre too lazy to read that, you should use common sense. if you have neither, you got a problem. and apparently its wrong to kill 4 people while blazing around in your pickup superbowl drunk with way too much other people in your car.

yes, he is young, and yes, everybody makes mistakes, but comon man! this isnt a tiny little "mistake". this is going flat out full retard. and if you endanger/kill/injure others knowingly, you go to jail. end of question.

this "he doesnt know right from wrong" and the general "i was drunk" excuse are utter horseshit. anybody who is allowed to operate a car has to evaluate himself and is responsible for not ending up in this situation. if you like to run over innocent people when youre drunk, give your keys to a friend with less fucked up hobbies.

Sending this kid to an expensive rehab to be coddled because his parents couldn't smack him around is not justice for taking the lives of 4 people (who were in the fucking act of helping another). If my child was taken from me because someone made the choice to drive drunk, and all he got was an ticket to a mansion? I'd rage.

What a slap in the face to the victims families, on top of their deaths. Wow.

After reading the story I actually somewhat agree with the punishment he is receiving. I'm not saying what he did was not a horrible thing and should go unpunished and that his defense of Afluenza wasn't pure garbage but I do agree with the end result. I do slightly agree with his defense of not being taught responsibility and right from wrong but would much rather that it not be linked to his families wealth.

The thing is for the majority of crimes especially made by younger offenders, he is 16, I feel like jail is not usually the best solution. Instead I would much rather see programs that would help them be better people and help rehabilitate them back into our society so they are able to become contributing citizens. Kids make mistakes, in this case all be it a costly one, it was still a mistake and I don't feel like the rest of their lives should be ruined because of that, in general not just this specific case. I am advocating for this method for all; from the rich to the poor, whites or minorities doesn't matter. The problem is these programs cost a lot of money and the government won't pay for them so they are not available to all offenders. Since his parents can pay for it out of their own pocket I do agree with him being sent somewhere for treatment, but it should be legally enforced that he stays there for a long period of time or be sent to jail. That mixed with the 10 year probation period so if he ever gets in trouble with the law again he is sent to jail for a long time because he used up his one chance, sounds like fair punishment to me.

Also yes I do agree with rich people being able to get out of crimes, like drug charges not murder, by paying to go to rehab or treatment because I feel like everyone should be given those opportunities sadly many can't afford that solution and the system the way it is would rather send a person to jail to make money off them then offer rehabilitation programs.

Just my $0.02 though

I respectfully disagree. The thing that people aren't realizing is that the article said he was facing up to 20 years, not 20. I think sending him to juvy for a year or two until he reaches 18 or 19 while he still receives therapy and schooling would've been much better. He gets punished, but still gets the help he needs. I agree, sending this kid away for 20 years would've been completely inappropriate. 1 or 2 years though, especially in juvy and not "real" adult jail, would've been fine. Then, when he gets out, send him to the fancy treatment facility. I do see what you're saying though, I just don't think he'll be sorry for what he's done if he already doesn't know right vs wrong and then he gets this slap-on-the-wrist of a punishment for ruining dozens of people's lives.

This article is such a shit ganache of sensationalism that it isn't even possible to get a reasonable account of the case.

- Way to eat up the completely irrelevant topic of the kid's financial status
- "Justice?" What are you, a chimp? How does fucking up another life help anything? The kid has to live with the fact that he just murdered four people; it's not as if he's getting the last laugh about how he "got away with it." Hell, put him in boot camp or send him to the front lines. Claiming another life by locking him up so that the families can delude themselves into thinking it actually changes anything for the better is just barbaric and pointless.

I see what you are trying to say and agree with most of those points the problem is the therapy and schooling available at most juvenile facilities are just not as good as they should be and for the schooling at least it will hinder his education and shut even more doors for his future. Many will say he doesn't deserve the same opportunities as he had before because of what he did but the idealist in me says he should be given the chance to get a great education to get into a good college and hopefully be able to make it to a position where he can do good in the world, if only eh. Going on what happened though his lawyers if they could would have tried to get the kid off Scot free so 10 years probation I can live with. If he isn't sorry for what he did and continues to live with a disregard for the rules he will be sent to jail on the most minor of infractions. But if the judge did what you suggested I would have no problems at all because yes he deserves to get punished I just would like the punishment in general to shift from detention to rehabilitation.

Valid points. I just would've liked to see him do a little time. I feel like he pretty much got off without punishment seeing as probation will only factor in if he commits more crimes in the future. And as for the therapy, he needed that anyway, and living at a posh treatment facility for the rich isn't exactly punishment to me. The families of the victims are the ones I really feel for in all this.

I'm all about rehabbing people.

But this is a spoiled kid who does know the difference between right and wrong. He just chooses to do wrong because he's never had to pay a consequence before.

And he's still not paying. He's still being told its ok to do something this severe and not have to pay the ultimate price. He's never going to learn his lesson if he continues to be coddled. He's getting a slap on the wrist compared to what he should get.

The court is doing exactly what his parents do.

He killed four people. Four people paid for his bad choices. Two of them young girls who had their wholes lives ahead of them. Two parents. All of them helping another citizen out of their good nature. I just don't agree his sentence is justice for the crime.

Why do you hold prison time to such a higher level of punishment vs. what he's going through now? If you feel for the families, you understand absolutely nothing in the world can make them feel better. So why does him spending 3 months, in a cushioned prison facility (c'mon, did you think he was going to end up in big-boy max security) really does much for anyone? Besides clogging up prison facilities and taking money out of your pocket, of course.
Ultimately 10 years on probation* and the requirement of deep psychological analysis has the propensity to do a whole lot more then being sentenced to "do a little time".

For anyone who doesn't see the logic in that and just wants to focus on his wealth, that's how our judicial system works. Cry about it some more

Because what he's going through now isn't punishment. Being exiled to an ocean beach house treatment facility in Cali for rich kids is not punishment. Probation isn't punishment unless he fucks up in the future. You're a pussy if you think that's punishment, I could go through that and not bat an eye. Of course, I have empathy so the real punishment for me would lie in living with what I'd done. But this kid was never taught right and wrong and doesn't have empathy, so he probably won't be plagued by that guilt.

If you actually read the article, you would have seen that Boyle thought that money prevailed and expressed obvious dissatisfaction with the sentence. And the 24 year-old's mother was "mad" about the sentence, so yes, seeing him in prison, even for just a short time, probably WOULD make them feel better. Never said I thought he was gonna get max, don't know where the hell you pulled that from. But 1 or 2 years in even a cushy prison is a punishment, unlike a vacation to Cali for therapy paid for by your rich parents.

One person isn't going to "clog up" much, and I have no problem paying for this dangerous kid to be locked up for a little bit to teach him a lesson. There are millions upon millions of people paying taxes in this country, you make it sound like a huge percentage of the taxes I pay are going to go to his prison expenses, it literally might be millionths of a cent.

I agree with you that therapy will do a lot more, which is why I said he should get a light term in juvy WITH standard prison therapy (1 or 2 years at the most), THEN go to the treatment facility afterwards.

I'm not crying about anything, douchebag. The fact that that was your ending "dig" at me says a lot. I was simply presenting my view on the topic, if you don't like it, you don't have to reply to my post.

You have absolutely no idea what this facility will do in terms of rehabilitation, instead your post just regurgitated everything that article said. You just happen to take it a step further implying this 16 year old doesn't have tremendous maturation to go through in some of the most developmentally important years of the human life.

You argue that probation is only punishment if he fucks up again? I won't waste my time here, perhaps you should research the term 'probation' and the varying degrees a little more and come back.

The article is completely sensationalist and biased, we all know this. I've read other articles about the story, and it was on the news this morning. The fact that you believe I drew my entire opinion from that one article in the OP is laughable. I didn't eat up anything from it. I formulated my own opinion based on the fact that he killed four people while driving drunk and is being let off with probation and therapy.

What exactly did I regurgitate from the article other than quotes from the family members? These are quotes from them, not the article. You said the families wouldn't feel better about the situation if he went to prison and I proved you wrong with actual words from the families.

I know what probation is. It's not a solid punishment for killing four people and paralyzing two others, period. When I said probation wasn't a punishment unless he fucks up again, I probably should've said serious punishment. At worst, he won't be able to leave the jurisdiction, might have to perform some community service, submit to drug testing, or wear an ankle monitor, among other possibilities. These are punishments, but they're pretty tame compared to the alternative.

How do you know in what ways they're going to restrict his freedom at this treatment facility? You said yourself that we don't know what will go on there. He might be able to walk around town, or go out during certain times while he's there. In fact, I expect that will be the case, because it's a therapy facility and not prison. So no, prison and being sent to this facility are not necessarily the same thing in terms of keeping this kid off the streets.

Your post is pretty "interesting" as well, seeing as you believe that I'm regurgitating the defense's argument. When I said that the kid never learned right and wrong, I was trying to explain why in my opinion that meant that he should've gotten time to teach him right and wrong. I was not agreeing with the defense as you mistakenly interpreted me to be doing. Hell, it didn't even work, he still got convicted. It just caused the judge to soften up on him. You seem to be completely missing the irony in the fact that the courts are doing the exact same thing that his defense team argued was the cause of his crime. Lack of punishment, and not teaching right and wrong.

And here is the issue: of course anybody would be better off with therapy and no jail time surrounded by convicts, but how many people don't get that and just get sent to jail instead?

And you seem to think in this case the punishment should be about bettering the accused, not justice for the victims. 4 people got killed by a drunk driver, he should do hard time. Its that simple and its usually what happens.

And to you're whole innocent since he didn't know better argument, if a kid gets bullied his whole school life and is abused at home decides to kill the bully, he still goes to jail for murder. If he just would have been caught drunk driving, of course i wouldn't be saying prison. But he killed 4 people. So what if he was desperate for attention? That doesn't give you a pass on the punishment the rest of America would have received.

The thing is the courts can't suddenly decide this 1 kid deserves a break for all the other non rich kids who get fucked over by the same courts everyday.

And to you're starry eyed vision of how courts work; no. I've dealt with a public defender who suggested i plead guilty to a crime i wasn't part of, and when my parents decided to pay for a lawyer i got off with nothing. The verdict may be not influenced directly by money, but every step along the way is. And even having a good lawyer for sentencing can be the difference between a year and some community service. Having a really good lawyer is everything, and if you don't think that you haven't had to deal with the court system.

It was a ridiculous decision, but it looks like it is going to pave the way for a huge civil suit against the parents. The testimony shifted blame from the idiot kid to the parents. All of that testimony should be able to be used against the parents in a civil suit. It won't bring back the people who were killed, but will hopefully go a long way towards bankrupting these idiots.

I'm not entirely sure what locking him up for 20 years would accomplish besides schadenfreude. It's not going to bring the dead back to life. Sentencing principles aren't just about revenge. I dunno, this is just not really anyone's business, it's just outrage porn.
