New York City confiscating rifles and shotguns

The New York City Police Department (NYPD) is sending out letters telling gun owners to turn over their rifles and shotguns — or else face the consequences.

New York City’s ban on rifles and shotguns that hold more than five rounds is now being enforced, according to a letter the NYPD is sending out to targeted city gun owners.

“It appears you are in possession of a rifle and/or Shotgun (listed below) that has an ammunition feeding device capable of holding more than five (5) rounds of ammunition. Rifles and shotguns capable of holding more than five (5) rounds of ammunition are unlawful to possess in New York City, as per NYC Administrative Code 10-306 (b).”


“You have the following options,” the letter explains.

“1. Immediately surrender your Rifle and/or Shotgun to your local police precinct, and notify this office of the invoice number. The firearm may be sold or permanently removed from the City of New York thereafter.

2. Permanently remove your Rifle and/or Shotgun from New York City and provide the following…Disposition Report/Registration Certificate…Notarized statement of permanent removal…Utility bill or other proof of residency regarding the address where the firearm will be stored outside the City of New York.

3. You may call to discuss the matter if you believe your firearm is in compliance…”

Departing New York City Mayor Michael Bloomberg is a major gun-control activist, with his coalition recently sponsoring an ad that depicts an Adam Lanza-type character entering a school full of children.


New York state, meanwhile, passed the NY SAFE Act in 2013 in response to the Sandy Hook shooting. The law, which bans “high-capacity magazines” and puts in place other stringent controls, was signed by governor and 2016 presidential hopeful Andrew Cuomo.

wow NY is such a fucked place, can you still not buy 2 litre sodas there? with all the random searches going on, and now this, its like your rights are just irrelevant in that shit hole.

what i really dont like about this is that its creating criminals out of perfectly fine law abiding citizens. and what are you supposed to do if you're one of these just turned criminals? give up your constitutional rights because your police state city wants to ass rape your freedom? its like a lose lose, you're not really abiding by the laws by giving up your guns/mags, you're giving up your rights because a corrupt government, thats basically breaking laws itself by creating laws like this, says you have to.

obviously the immediately "safe" thing to do is to just listen and abide, but its definitely not the right thing to do, certainly not morally right. its just putting regular law abiding citizens in position to become criminals by allowing their rights to be trampled on. maybe thats the objective? to create criminals? putting gun owners in this situation is creating a perfect scenario to become a "bad" gun owner by not giving up his property, thus making the regular ol' gun owner a bad guy, which will hurt their perception and make taking away more guns in the future, easier.

whats even more ridiculous is that they aren't doing shit to ACTUALLY SOLVE THE PROBLEM. gangs and career criminals account for about 80% of the nations gun related crime. but you never hear about that. its always the redneck on his property shooting soda cans with an AK that the media portrays as the real bad guy. rifles in general, and more specifically assault rifles are only tied to one of the smallest fractions of gun related death in this country. dont remember the exact statistic but its a fraction of 1%. and i think the number was something like 20-60 deaths per year were actually involving an "assault" rifle.

so yeah, lets focus that, the non problem. not the gigantic majority of the problem, that would be silly.

the first amendment protects your right to say anything you want, but doesn't protect you from the repercussions of such actions. if you reveal something that jeopardizes national security, you have every right to do so, but the government will be able to punish you accordingly.

Yeah, and when that actually happens, we will change it. But right now, the popular opinion amongst Americans is that they still want their guns. So yeah, people still like guns, their opinions HAVEN'T changed.

The politicians who made this law are jumping on the sensationalist "school shootings, oh nooooooo" bandwagon. Almost all gun homicides are from handguns. They're just reacting to shootings committed by insane people like Lanza and arbitrarily taking hunting and personal protection weapons away from law-abiding citizens. What the hell does five shotgun slugs vs eight matter? I can still kill you with one, so what's the huge deal? Do they think criminals are going to care about gun laws? Fucking retards...

well it doesn't apply to everyone. gun laws vary by state and in many you have to undergo extensive background checks to to obtain one. i'll leave specific statistics to someone more versed on the issue, but I know that the amount of perceived gun violence is severely disproportionate to the actuality.

we as a people are sheep. we fully consume what we hear and hardly question it (sorry to generalize but largely true). when we have a media that only addresses the most drastic, inhuman uses of weapons, and does so on a national scale for weeks and months, we are inevitably left with these negative notions. the president does not address examples of guns being used for self defense, because that doesn't fit his agenda. I'll refrain from using the self defense argument, because although valid I don't think it should be the focal point of the debate. Rather, we need understand the issue of gun violence in an entire sense and not only what the media tells us. In these current events you reference, am I right to believe you're referring to incidents such as the newtown shooting? When these incidents occur, or when someone is shot on the streets, how often are those weapons legally owned?
I ask that question somewhat rhetorically. I know for a fact that the percentage is low, but as I said before I don't have enough exact knowledge on the subject to pull out factual numbers. I'm totally with you on the regulation. But you still need to understand that we have rights. Each time new laws such as these are passed, they are a small step towards a large goal. Change is incremental and if you give a mouse a cookie, he'll only come back for more.

When I bought my 12 gauge shotgun in high school, there was a plug that came with it that I was supposed to put in it. There was a restriction for hunting that allowed for 1 in the chamber and two in the pipe (pump). This was only a requirement for hunting. I never bothered to put it in. There is nothing preventing you from pulling the plug out or just never putting it in. They would have to physically exam your gun and see how many shells it would hold to determine whether it was legal or not. They would probably need some kind of warrant or cause to examine it.

Yup, I'm sure this is the type of news that wouldn't be widely reported and debated by every major news source. And there are just so many examples of the supposed letter being posted online.

It all came from one questionable letter, on one questionable website.

No one is drive 3 hour a week up state to hunt, you don't need a shot gun or rifle if you're living in the city, and if you are then you are very wealthy and have a second home somewhere keep it there or at a gun range near by. firing off a shotgun in an apartment building in NYC could do way more harm than good.

Exactly my point as to why having it plugged wouldn't skirt the law. Hell I know guys down here that back in the day used to just put a wooden dowel in there.

I don't know about that last part. Remains to be seen. Load up hunting gear to head to the mountains for the weekend, get pulled over leaving the city for any reason and the cop sees you're shotgun in the back. I mean I could see them wanting to inspect it to make sure it was legal. Who knows how this is going to be enforced in many different situations.

Who knows if it will be enforced at all. Is it true under this same set of laws that air pistols and rifles are outlawed in NYC???

I'm pretty sure NONE of those were rights in the Constitution besides slavery. There's A MASSIVE DIFFERENCE between owning another human being and owning a shotgun or rifle, I shouldn't even have to say that. One can be done without violating OTHERS' liberties and rights, and one can't.

Why would you need a shotgun in NYC? Are you serious? Self-defense. It's the biggest urban area in the USA, the chances of getting burglarized are higher than most other places. And a shotgun CAN be (although not always), a better home defense weapon than a handgun.

This isn't about why you need a shotgun, it's about why you shouldn't be allowed to have one when the federal "law of the land" says you can. I don't even own any guns, but punishing people who have registered their guns and are obeying the law is fucking stupid. There will still be +5 shell shotguns carried by and available to criminals.

Think about it this way: These people went out of their way to obey the law and register their personal weapons. Then, because of the actions of a few criminals, they have their guns that are not being used for evil purposes taken away, while the criminals get to keep theirs. This isn't about keeping anyone safe, it's about PR and making the city look like it's cracking down on gun violence by taking away guns from people trying to protect themselves from violence.

I'm not advocating for the 2nd Amendment, that's not for me to decide. I'm arguing that this law is fucking stupid, which it is.

From what I recall, you've never been allowed to have a shotgun or rifle in NYC. Only handguns with a permit of course :)

Not to mention 5 shotgun shells/slugs/whatever is still PLENTY of firepower. This law effectively does NOTHING whatsoever but take a few hunting/self-defense weapons away from law-abiding citizens.

That is, assuming the law is real. As other people have said, this is only one source.

Ironically, firing a shotgun in an apartment building would be less likely to cause an accidental casualty or whatever the technical term would be for shooting someone you weren't intending to shoot. A hand gun can easily go through a wall and kill someone in an adjoining room. A shotgun is less likely to do that. If I lived in an apartment building, I would feel safer knowing that my neighbors had shotguns for home defense in stead of hand guns. I have always been amazed at the fact that more people are killed every year by 22's than by any other rounds.

I think that's a huge assumption on your part to say there are no hunters that live in NYC and travel to hunt. Hell I hunt at our family cabin in upstate PA, just last week I drove 2 and a half hours up there to hunt for one day. I keep my guns at home as our cabin has been broken into at least 3 times.

Thanks for that last statement though, of course that's true. I don't think anyone is defending the right to go blasting off a shotgun in apartment buildings.

You don't, I actually said that earlier in the thread, it's actually illegal in many states to hunt with more than like 3 or 4 shells loaded in your gun. That's not to say the gun can't potentially hold more though without a plug in it.

well I'm basing this entirely on Canadian law, which I'm used to.

You can buy mags that hold 30 rounds for a centre fire that are pinned to 5. There's absolutely nothing stopping you from punching/drilling the pin out. It would take 15 seconds then you all of a sudden have an illegal weapon.

But the extra rounds aren't worth the risk of getting caught. But yea, nothing stopping you from removing it, but as soon as you do it would be illegal. So why would you? Not that the law makes too much sense, but it's still a law so why break it for another few shots from your gun?

Doesn't make any sense. I could see them banning guns and clips that can hold >5 rounds, but only to the extent that it's illegal to sell or produce them. This, here, though, is absolute bullshit. People have the right to property and they shouldn't be allowed to take that away.

I drive 2 hours every weekend to go skiing and during hunting season I drive 3 hours to go hunting for the weekend, 3 hours isn't that far.

I would really like to see someone give me one good reason why I shouldn't be able to own my hunting rifle, or why I can't own a pistol for target practice/ self defense.

so if this happens to be a real law in NYC I will be able to own a S&W .500 magnum (5 shot revolver) completely legally but a .38 or .22 (6 shot) is illegal? since it has 1 more shot it is therefore more deadly?

People always seem to think "oh, its in the constitution because they were old fashioned poor farmers, they needed they're muskets to hunt and feed their families, we don't have any need for guns now." That is so far from the truth. The EXPLICIT reason the second amendment was written into the constitution was so that the people would be able to defend themselves from a potentially tyrannical/corrupted perversion of the Federal government, years on down the line, just like they were doing in the 1770s.

I don't really know the deetz. I just saw it on phantasy tour(phish forum) earlier. Supposedly it's a yearly thing for schoool children.


That said I googled it just now to see if I could find something out and link it and 2 of the top 10 results were "inforwars" and "prisonplanet" (That douche alex jones websites)

So I have no idea. Could be real could be total bullshit. I just figured it helped the argument I was going for whether truthful or not.

Oh, okay. Yeah, they made my friend who never gets vaccinated (dumbass conspiracy theorist parents), get his chicken pox vaccine before he was able to enter the 9th grade. That was just the school district though, it wasn't forced by the state government or anything.

New York's gun laws are so fucked because most people who are making these laws know nothing about guns. I give you Carolyn McCarthy (my congressional rep) who basically pisses her pants at the sight of an "assault weapon" http://www.youtube.com/watch?v=ospNRk2uM3U

People who know nothing about guns except that there evil. They listen to everything Piers Morgan spews about guns. They don't realize that gun laws only truly affect law abiding citizens and either way a criminal breaking other laws isn't going to bat an eye at a 7 round magazine limit.

They think violent crime is sky rocketing when in fact it's been on a consistent downward trend for a while now.

The average person doesn't realize the only thing that comes from gun registration is eventual gun confiscation. Cuomo himself even said "confiscation could be an option" in regards to assault weapons. The amount of crime that is committed with semi automatic rifles in miniscule at best.

And lastly the term assault weapon. It sounds scary and mean and like something you could only hose down innocent people with. The term only denotes cosmetic features of a weapon like a pistol grip, flash suppressor, or collapsible stock. It has nothing to do with the actual function of  the weapon. If you put a pistol grip on a ruger 10/22, because it has a detachable magazine, NY considers it an assault weapon.

/end rant I have no idea why I'm even writing this.

Meh, I think parents should be able to have a say in it. Subject is a slippery slope in my opinion. There are plenty of healthy children that have parents like that. I'm not saying they are more healthy than other, but a parent refusing to vaccinate their kid isn't like they're throwing their fate on a roulette wheel.

There are also cases where a child had an allergic reaction to a vaccine and ended up with permanent damage. One of my friends when I was younger, his brother was the 1 in a million type stat on one of them. That doesn't mean that the good can't out weigh the dangers, and also doesn't mean they're 100% safe.

Funny because that looks to be the exact one I own.

I'd much rather defend my home with that than a double barreled 12 gauge as our vice president suggests.

Although I still want a double barreled 12 to hunt turkey with.

Drawing down on a game bird, I'm more than comfortable with a single shot break action, hell I enjoy the challenge.

Preparing to point a shotgun at a home invader that may or may not have a weapon.......yeah I'll take 6 or 7 or 8 shots thank you very much.

I feel like I read that 00Buckshot will travel farther and faster through walls then 9mm HPs, as well the spread of a shotgun seems like it would have a higher change of hitting something you weren't intending too. Besides that though I would still rather have a shotgun for home defense than every other gun because I know it will be reliable and I have the best chance of stopping a threat.
