The fact that you're arguing with me about the dad hitting a minor is fucked up. Like I said I am not a badass just a normal guy who learned from my parents how to handle situations like this and they certainly never taught me to hit minors no matter the situation. You must be pretty fucked up in the head if you think that's an okay thing to do.

False. This situation was entirely avoidable.

Both parties share some blame, but the snowboarder shares a higher proportion of the blame.

Skier Responsibility Code
  • Always stay in control, and be able to stop or avoid other people or objects.
  • People ahead of you have the right of way. It is your responsibility to avoid them.
  • You must not stop where you obstruct a trail, or are not visible from above.
  • Whenever starting downhill or merging into a trail, look uphill and yield to others.
  • Always use devices to help prevent runaway equipment.
  • Observe all posted signs and warnings. Keep off closed trails and out of closed areas.
  • Prior to using any lift, you must have the knowledge and ability to load, ride and unload safely.

    Prior to the main collision, the snowboarder had a VERY near miss with another young girl. He was not entirely in control of his self in this situation and obviously was unable to stop or avoid people or objects in his path. Now the father did appear to have his son start downhill without looking uphill and yielding, but that does not mean that the snowboarder has a free pass on item #2. It is still the uphill skier's full responsibility to avoid them, and if in full control and skiing in a responsible manner, this is a non-issue. The only time I'll side with the uphill skier in a collision is when someone is camping in a landing in the park.

    If you are cruising a trail and come across a congested section, ESPECIALLY when it is young children, ease up and slow down. Young kids don't always ski predictably and is creaming some little kid worth it?

Yes, I'm sure your parents would have been SO proud if you hospitalized an adult for giving some retard kid who just fucking OWNED his toddler a whack that did literally nothing.     i was landing from a jump in carinthia last weekend and a snowboarder tried doing some weird lip trick and i collided with him really bad. he didnt look to see if anyone was on the jump.

    i gave him two beers and we blazed on the lift.  but initially i thought for sure i was going to get sued.

    honestly lets be real if this went to a courtroom it would be a lot easier to prove assault on a minor then to prove the snowboarder did something wrong.

    one was intentional and one was an accident.

    Did I ever say I would hospitalize him or even hit him? How do you know I wasn't talking legal action? See you assume shit and look like a jackass. In all reality I don't know what I would do unless I was in the situation but something would be done. Even if it was explaining to resort management that this adult shouldn't be allowed to ski at said resort again because he struck a minor. And I might hit the guy, idk what I'd do but I know I wouldn't just sit there and let that happen. The kid may have been an idiot but he didn't deserve to be hit.

    This is an honest inquiry here. How would the snowboarder be held legally responsible in this situation? All resorts require that you sign a waiver of liability that frees them of legal action so I can't see why any INDIVIDUAL can be held accountable for an honest MISTAKE (yes I agree the snowboarder was the primary person at fault and could have avoided the situation. Regardless, aside from being impaired on the mountain and causing an accident like this are people really liable for an accidental collision? If so it seems like another place where the judicial system in our society is failing miserably.

    From the video the dad hits the snowboarder with the palm of his hand, not the ski. So not as crazy as it seems. The snowboarder messed up, and so did the dad. And to Mr. Huck, honestly your posts are all true but when you first posted about how when it comes to your own kids "all bets are off" or whatever you just sound lame. Kids with parents like that are the ones who grow up not learning to take care of themselves or handle their own problems.

    Either way for some reason I keep laughing at his buddy when he air humps right before the accident and after when hes screaming at the dad.

    That waiver releases the RESORT from liability of injuries incurred as a result of using their facilities, it does not protect individuals from litigation against each other in the event of an accident.

    As a degenerate father with a kid who skis, I will say that dad is a fucking dumbass who should be smoked in the face with a skateboard. I bet he wouldn't have hit the guy if he was a 40 year old racer in lycra. With a temper like that, dude is prolly just weekend dad anyways.

    Not saying the boarder wasn't an awful rider who didn't know how to cruise through a busy run. If that would have been my kid, I would have checked on him, checked to see that the other CHILD was OK, and then punk the shit out of him with words and make him feel really stupid in front of his friends.

    Shit happens, dad shouldn't of hit the kid, and kid shouldn't have bm'd away and at least checked on the little skier dude.

    snowboarder was at fault.. the little girl on the left and the little kid who got hit popping out were definitely tough breaks but that's part of runs like that and if the snowboarder didn't suck he would've been able to get out collision free (or, wouldn't have been between the kids at all)

    that being said, he gets points for trying to apologize sincerely, and it's worth noting that the dad freaked out on the snowboarder before even checking on his kid, and the kid didn't even start crying until the yelling started (could've been a delayed reaction period but it leads me to believe he wasn't hurt, just freaked out at the whole situation and once the yelling started it was his cue to cry as kids do)

    run the numbers...enhance...zoom into the reflection of the dad in the little girl's goggles in frame 34:23...enhance..run the numbers again..

    VERDICT: i'm way better than everyone in this video

    not the snowboarders fault at all.

    If you look at the shadow you can see the snowboarder actually got hit by that other kid which caused him to collide into someone who was cutting perpendicularly across the hill and failed to look uphill.

    if you come across the trail and then FAIL to look uphill then it is your fault if you get hit.

    It's where I got that earlier example. Pretty much the common theme in all of them is that, if you are the uphill skier or boarder and you hit someone and cause them injury; you are truly fucked. These settlements are huge. We tend to look at it as "shit happens", but the legal system is pretty consistent on this.

    Anyway, I'm done with this thread. I apologize for coming across as "Dickhead Dad". There are other dads on NS, and they will tell you that your perspective changes a lot when you have kids. Rational thought goes out the window when one of them is threatened.

    In El Gato's second forensic picture, the snowboarder can very clearly see the little kid he's about to take out. They should have some sort of skier/snowboarder safety class for skiing out of control, like wreck less drivers have to take. The snowboarder was clearly at fault here, the dad should've checked on his kid, THEN hit the snowboarder. When you see your kid get hit, its an awful feeling. Common sense takes a back seat to emotional reaction

    yea this guy was not in control. you can tell by how oddly he chooses his line through people. the dad got way too mad and shouldn't have hit him, but the dude coulda really hurt that kid and barely made sure the kid was ok aside from "you okay dude?" that snowboarder's a sissy for just leaving like that.

    I woulda taken my board off and fucked that dad up and taken the kid to patrol to have him checked out. Some people dont understand how terribly easy it id to knock someone out with one shot. He wouldve gotten his ass handed to him by a crew in the midwest anyway
