I definitely wouldn't be surprised if it did make it to court. I don't know all of the evidence but if they play their case right they could definitely have a chance. Much stupider cases have won in the past.

The claim on this lawsuit is not that the caffeine killed the guy, but that there are other stimulants in Red Bull and other energy drinks. The problem is that this law suit might compel the FDA to take a closer look into the ingredients in Red Bull, Monster, etc. If the FDA identifies and decides to target a specific ingredient such a Saccharin during the 70's, then the sue happy sharks will be lining up to take a bite out of Red Bull.

I have no idea how this will play out, but if the FDA gets involved, all bets are off.

Monster has been sued for a few deaths over the last few years. In one of the cases, I think I remember reading that the person would have to drink 80-something monsters at the same time to be lethal. Obviously that's impossible. I don't expect anything to come out of this just like nothing has happened to monster in their suits. Red Bull probably has been sued like this before as well.

How much do you know about that case? In my opinion it was pretty substantiated given the negligence by McDonalds. Its sort of sad that the media used that case as the poster child for frivolous litigation. This redbull case is bullshit though, I don't know enough about their ingredients but I can't imagine the drink had anything to do with his death, some people just need a scapegoat for an unfortunate circumstance.

How did you miss that 180+ causes third degree in 2 to 12 seconds, she also wasnt asking for much money, she thought that McDonalds owed her medical expenses and that was it, if McDonalds wasn't negligent in heating the coffee to 180 or so degrees then I highly doubt she would have won the case. Even McDonalds acknowledge that they were putting customers at risk by serving them coffee higher than 150 degrees in poorly designed cups.

The judge rightly assigned blame on both parties and reduced the damage to McDonalds. If McDonalds had published the temperature or warned about its extreme heat then the lawsuit would have been null but they failed to inform the consumer resulting in a lawsuit. They could have also avoided a lawsuit if they just paid the stupid customers medical bills...

Sure she gets burned, but McDonalds must inform customers that what they are purchasing has the ability to do grave bodily harm, they were also using substandard cups not designed for coffee at that tempereature, both of which could have (but probably wouldn't) prevented the accident. I don't even necessarily agree with the laws that were used to get McDonalds to pay, but it seems pretty agreed upon in the business law world that the case, not necessarily the payout was justified. McDonald could have helped her out with the medical bills and avoided the millions that they had to pay.
