I'm pretty sure it's only illegal to not report a crime if the Cops ask fro information. If they ask and you don't tell them, it's illegal, but not if they didn't ask.
You can only get charged if your state has good semaritan laws or whatever they are. If it does you probably won't be able to get yourself out of it. Finally I've actually used something that I've learned in school.
There was a case where 20 kids witnessed a gang rape in Cali, didnt report it, and no charges brought on them. This is bullshit if you get in trouble for this
Thats part of your miranda rights so i think that really only applies when you are in custody,If cops question you and you dont tell them what happened technically you could be could be considered an accessory after the fact, or charged with interfering with an investigation. But you dont have to come forward to the cops about a crime you witnessed. I would recomend doing so if you are getting charged though.
The wording of many laws is so ambiguous that literally anything could be illegal if they wanted to charge you for it. Doesn't mean it will hold up in court, but you'll still have to fight it.
From what I can tell, you haven't even been charged with anything. Given that you haven't actually committed any crimes I wouldn't worry too much about it. Don't bother getting an attorney until you're arraigned.
wait what proof do they have though? and what are they trying to charge you with? just say you are unsure of what they are talking about. If the penalties are high like $500-$700 a lawyer would be worth it and you would for sure get out of it.
