Replying to Calling Shotgun

ok, so i'm in an arugment with my friend. He's arguing that it is completely legal to call shotgun in front of one of the three people in contention for the front seat when he is NOT in my presence, therefore me having no chance whatsoever to get my say in. I was always told that all the people in contention for shotgun had to be present at the same time, and the car had to be in plain view. Now he says it is completely fair that he gets it even though i had no chance. Also, he called it two days ago when the day we're calling it for isn't until saturday night. So, minus the bullshit answers, what should we do?
