Watch some university cops fight with a douchebag. Not sure if unwarrantable search + seizure applies to campus dorms, but if it does these 'cops' are in heaps of trouble. Funny video as well

So that makes it more okay or less okay that he was shot? I always find it disturbing how after these incidents there is always some type of hidden illness that makes it more tragic. I'm sad for his death, but the whole bipolar issue should stay out of it. Half the population is bipolar if they really wanted to go out and get treated for it.

Where it matters is someone who may behave erratically or be unable to follow commands is doing so as a result of their uncontrollable mental illness and not moral faults.

This is not a case of the gang banger who was a "good kid."

Claiming half the population are bipolar reflects a poor understanding and disregard of mental illness and science.

I watched about the first 1:30 and wanted that kid to get the absolute shit kicked out of him. Does it get any better than him just acting like a cock gobbling frat douche? I don't think I want to watch any more of the video unless something exciting happens.

His best arguments were "you can't fucking come in here!" and "that guy is 45 and he has fucking braces what a loser!"
He looked especially like a fucking idiot because they actually could search his room and he had no clue. I don't really care if he's bi-polar, if he's not going to let the school know of his mental illness then he should take his meds and shut the fuck up. People need to learn that knowing your rights doesn't simply mean saying "no you can't search me", it means KNOWING YOUR FUCKING RIGHTS, and when he's living on their campus, in their residence, and signed their waivers, they have the right to search his room.

And to put the icing on the cake, that guy has NO IDEA what the word "belligerent" means.

Kid did not know what he was talking about and was way to rude. If you don't want to let em in then don't let em in(even though they do have the right to come in), don't just stand there insulting them.

But they did search the room and didn't find anything, he shouldn't be kicked out of school. Maybe kick him out of housing for being belligerent and not letting them search, but that shouldn't kick him out of the academic side.

Not sure if was posted already, but the cop was fired. Sure the kid was a total gaping asshole, but its not illegal to be a dick. He has rights and the cops violated them.

as the student was living on campus housing, technically he holds no right to ownership, so demand of and procurement of a warrant to him personally is meaningless. universities are allowing the search and seizure of property in dorm rooms without a warrant, otherwise known as "health and safety" searches when probable cause is seen fit. most of the times, these searches are agreed upon by the student when they sign any contract allowing them to live on campus. whether or not the findings from the search hold up in court vary, however, depending on the constraints and concessions put in place by the housing agreement.

MA Supreme Court Case Commonwealth v. Neilson which is cited frequently for campus dorm search and seizures states "not only the general validity of such a housing agreement for Fourth Amendment purposes, but also the limits to which searches conducted under such policies may lawfully extend."

Never got to see the video since it was taken down. But, just like many people have stated already, you do not have the same rights when living in a dorm room. They can search your room whenever and for whatever reason. If I remember right they can't just barge into your room though. They have to knock and you have to open the door for them (not 100% sure on this one but I believe that is what my RAs told me.) But there are a couple things they can't do like open up a safe if you have one or look in your fridge.

The quote from the student at the end of that article pisses me off so much. He is such a piece of shit.

But now that I finally saw the video (or at least part of it), the only thing the officer did do wrong was shoving him, he was in the wrong there.

Also it's weird that the dorm rooms have windows that open. Every school I have been to has it's windows permanently sealed shut.

I'll get push back for this, but he deserved it. The kid was being a complete piece of shit, but that officer was totally in the wrong and the university took appropriate action. Not a fan of his comment at the end, but that's definitely what the kid did and it worked. The student tested the officer's ability to remain calm and he proved to be a hot head, which is the last type of police officer I want around me. Glad to see this.

That kid is a boss. He wasn't so quick with the comebacks, and his insults were a little puerile, but he achieved his objective perfectly. Glad to see you actually have freedom of speech when talking to the police.

Also, for those of you who think police have the right to search your room, you're idiots. There is nothing in the Constitution or case law that permits the police to search a dorm without consent or a warrant. University administrators are allowed to search your room on whim, but nothing they find can be used in criminal prosecution.

Also, what college kid pours out liquor? That should have been the first clue to the cops that their information was bullshit. And even if the kid did do it, why in the world would they punish him for throwing away alcohol? None of this makes any sense.

That dorm prob had the "dry" rule, hence if he was throwing away liquer it was still on the premise which is not legal. But I agree with the kid that it isn't probable cause for them to search his room.
