Your only on ground for litigation if, and only if, it is a publicly claimed comment (i.e. published press release) with a DIRECT INTENT of damaging the company also known as slander.
It can also be published written word known as libel defamation.
Both slander and libel defamation are torts which are not subject to criminal law, but personal civil cases.
Additionally, it is NOT illegal so you are not bound to the law and punishments thereof.
It is solely situation dependent and how much lead the civil courts intend to give you.
