Im not living there anymore I paid my share and left for ny this is in breckenridge co I'm just trying to figure out if I get my security deposit back because I have $580 I would like to get back but being that my roommate didn't pay rent I'm probably never to see that money. Just want some tips on how to be professional about this over the phone explaining the situation.

if youre the only one on the lease youre the only one responsible for paying. He will keep your deposit, he might sue for the amount of rent up until the next tenant moved in (he would win) and have your wages garnished, it's a huge hassle. You can in turn sue your friends in small claims court, a judge would probably side with you in that situation.

I'm a landlord, and would probably sue you in small claims court for what I'm owed. I can't pass the loss along the chain (except as a business loss on taxes). My signature is on the bank loan, and HOA's will put a lien on your property if you don't pay. And attempting to get payment from someone who was never on the lease is near impossible.

It's a shitty situation, you need to talk to your friends or their parents if they are young. Or you can just wave good bye to the security deposit and hope he has better things to do with his time than going after the remainder.

Contact your landlord an outline the situation plainly. Ie when you left, payments etc. tell him you were done with this place and moving On and were contacted in ny. If this kid I still planning on living there you have him by the balls because you could just tell the landlord it's on him and hell have to do something if he wants to continue living there. Regardless of lease signing, it sounds like you were at the end of yours and frankly as a landlord, I wouldn't go through the hassle of bringing you to court from across the country unless you destroyed my place and I had no contact with anyone currently there. Jut be courteous and if need be get parents involved (sounds like you may not have been on your own too long). Good luck bud, If I have roommates we all sign the lease or someone else can. No fucking way I'd put my name on one of those again with roommates haha.

not very often. land lords get fucked over much more than tenants do. Plus for most cases (this isn't one of them), is they take it to court it's much harder for a land lord to win their case.

Odds are pretty good he'll just keep whatever he's owed out of your damage deposit, which is usually like a grand anyway. If it's short by a couple hundo he may not think it's worth bothering about. You could pay and sue these guys in small claims but that'd be a PITA.

it's not? close to $1,000 for a case that will easily go in his favor. It's not like he needs to do any prepping, all he needs to do is provide the judge with a piece of paper, which he has. I'd argue it's not worth zzskis time to take it to court because there's no way he'll win it, unless the living conditions weren't as stated in the lease

Idk i've known three people who walked out on their leases and the landlord didn't go after them, two of them were for 3+ months rent. I've also had landlords tell me that it's not worth the hassle of going to court, paying court/lawyer fees. Especially because for most landlords it's just a side job for a little bit of extra cash and not how they make their living.

well no i paid this girl and guy my last months rent and she didn't even give it to the land lord, but if they keep my security it'll come down to about 200$ if even that but im in ny and im not going to co good luck trying to get me into a court room. and i feel bad im not trying to screw over the land lord but shes need to talk to the people living there and tell them give me the money or gtfo.

good luck trying to get you in a court room? ha. dont show, and a default judgement is awarded. Then they can garnish your wages. Your landlord isnt gonna do shit about getting your money back to you from the girl.

Save those texts, thats the only evidence you have in trying to get your money back from the girl.

and btw, Usually there is a line in the contract that states the penalty for breaking the lease (ie. not paying the last months) is a forfeiture of the security deposit in addition to rent owed. The security deposit is just what they get without taking it to court, and wouldn't count at all towards and rent owed.

Well, in a lot of cases the landlord is able to re-rent the property fairly quickly. Between keeping the damage deposit and a quick turnaround to getting a new person in there, they actually don't lose any money. If you ditch your place on Tuesday and they get in another renter Wednesday paying the same rent, they CAN'T sue you no matter what your contract says because they weren't damaged by your breach of it.

As for it not going towards rent like someone said, I don't think that's right because if the place is suitable to live in deposit should come back with rent taken out. Were the other people on the original lease? Or was it just you on the lease? Did you sublet to them? This situation is kind of unclear how you have presented it.

You shouldn't have just bounced out of there with out getting your name off the lease. If you're the only name on the lease - just because you paid for when you were living there doesn't mean you can just leave. Since your name is on the lease you're responsible for paying for the term you signed for...

Before you moved out you should've talked with your landlord to get the lease assigned to the people who were still living there or you should have subleased to the people living there.

Also why did you give the $ to some random chick / guy to give to your landlord... You should've paid the landlord directly...

It seems like you made some dumb moves and got yourself into a really shitty situation.

Bad roommate situations blow... I had one last year because my friend's psycho girlfriend. I ended up talking with my roommate & landlord to get things worked out, my roommate agreed to take on my portion of the lease so I could move out.

I assigned my portion of the lease to my friend, so he took on two leases (expensive!), talked with my landlord to make sure my name was off the lease and that I was free to go. Then I moved away, and got my security deposit back.
