Non-Exclusive Licensing

Hey guys, got this email today and was wondering about what/how i should go about this.

Hey Joey,

I work for a production company here in Hollywood, CA producing a comedy caught on tape show. We are putting together a montage of people crashing while skiing and came across your footage on NS: https://www.newschoolers.com/watch/433732.4/Tim-DuBois-Gets-Mangled?c=13&o=3&t=2

Do you still have the original file for this video?
Please let me know as we maybe interested in non-exclusively licensing the footage.

Well...he hasn't offered you anything yet. So there's nothing to really do here but proceed with caution. Email him and let him know you've got it, but play coy. Let him reveal his hand first, you know?

It's nice that its a non-exclusive deal, you get to keep the rights. Lots of companies try and fuck us kids over when taking our shots. Nothing worse than selling your soul and ending up with your balls in a vice grip (that may be a bit dramatic on many levels).

You don't know if you get paid till he offers you something. I have no idea how this will go down, but it doesn't hurt to reply. You can always say no thanks.

And they'll own no more rights to the video than you do. No more than equal with you.

Basically they'll get to use the video but won't keep you from using it/giving it out/selling it at the same time. In the offer it may say something about number of uses. If not, you'll want to ask about that too.

For the time being, just reply. Nothing's on the table yet so there's nothing to worry about :)

Interesting, this is the second time a crash clip has been discovered on NS. I wonder if the website is being spread around these types of markets.

Basically what it means that if Rob Dyrdek's show wants to license this a month from now, you can still do so and make money on that too.

Tell him you have the original file, and you're down, ask him what he's able to offer in terms of compensation.

In the end, it's not like he's making you sign away rights to your name for free so even if he's not offering money, it could be cool. haha.

I will be getting $250 from nash ent

I signed a non exclusive with them and when your video airs on an episode they will pay within 30 days

Is it $100 for the license? Or $100 per use/episode? Sorry if this is a stupid question...

when i signed my contract with nash, the money was for the n.e license, and any other usages of the episode/video were covered under that contract.
