ESPN asking to use my video

Sorry for another post, but I want some advice, and pretty quick too if at all possible.

I got an email from nicole coffey from espn asking if she could use my video. Do I ask if we should talk licensing first? Her email doesn't really say much, other than they want to use it this morning... And i am not sure how to go about it.

Google a license online, figure out what you think it is worth.  If it's espn they have money don't be frugal.  But be smart as well giving away your video only hurts filmers and editors alike.

Ask what you think it's worth.  I always try to remember this: http://www.petapixel.com/2012/01/10/this-photograph-is-not-free/

basically like the photograph, you take the time to do it whether you consider it work or not.  That is your property personally.  Ask them to pay what you feel it's worth.  And for reference, I charge 1-2% of what my gear is worth when renting my gear.  For footage it really depends on what it is the running length and other things. 

Do they want an edit or shots?

well, its not really an edit. its the video of the urban rail skier. it has gone viral. it was on g4 and i've gotten 3 offers so far from companies for a non exclusive license. so i understand and know the definition.

In the email she just asked if she had permission to use it, which means that they did not want to go through the legal trouble of creating a contract, think I am dumb and don't know what a license means, or just wants to harmlessly use it and give credit to me.

I emailed her back and added that I would like to talk about a non exclusive license.

She did say she wanted to use it today, so I hope she still wants it tomorrow.

Normally I'd say just run with it. That much exposure couldn't be bad- except in this case, nobody is really going to watch it and say "damn, I want to hire that kid filming!" so it really won't do much for you. I say you do one of two things...

- try to get the money. If they don't offer to pay up, just don't give it to them.

- fuck with them hard. If they refuse to pay, just tell them "oh, ok, if you're ok I'll just add my name to it and then you can use it." and write your name across the entire frame. Or add some stupid ass effects from movie maker or put the website of a rival sports broadcaster or something

this is very interesting for sure. here are my thoughts.. there isn't much for filming here, basically just the camera rolling and nothing real "exciting" as far as me wanting to hire you to do my next project if that makes sense. kinda like what someone else said above.

that being said...this is probably the coolest most interesting crash/way to come off of a rail ever! you will never find something else like this and YOU were the one to capture it making you own the rights. so this is why i would see if they are willing to pay for the video for sure!

with THAT being said. you did put it on the internet to go viral with only your name on it for everyone to see. if espn aired it, it sounds like they want to do the same, just air it with your name like it is on the web. and if they do it that way, people who are at all interested will go google that which would take you to your original video anyway for them to watch on repeat over and over again.

so basically its quite the predicament.  If it was me, since its only a small clip, but yet very very very rare, i would ask for some form of monetary compensation because it is espn who attracts more viewers than the news guarantee, but if they aren't willing to pay much or anything at all, i would still say yes just to see my name on tv with my work. thats how i feel anyway

For the record, K_M you are wrong. Of course ESPN has a shit ton of money, but the budget for non-top 10 is probably very close to zero.

I don't know it for a fact, but knowing ESPN is a big corp and they probably have very strict budgets, im sure the financial people don't want to toss any money towards a 1-2 min spot that is once a week when they can take anything from their live broadcasts and use them for free.

Completely barring whether or not ESPN truly has the funds to pay you lying around somewhere, the simple matter is that someone is asking you to give them footage for free. Freelancers' approach to this will vary, but in my opinion: no money => frig off.

anyway i didn't email her back in time for her so it didn't go on air.

also just got an email from good morning america asking if they can get permission to show the youtube video on air. thought that was pretty cool. they are also not paying for license, so its more or less the same situation.

i think im going to let them use it, its not like this video is going to define my career. why not get it on tv?

These companies want to use your video because you happened to catch something really funny, not because of the production value or anything, so i dont know if all these rules about freelancers and stuff applies. try to get money, but if you cant, let them have it

im pretty sure it was CBC news. could be wrong though, and im in Ottawa Ontario. ... they were doing an interview with JP Auclair because of his street segment and they were asking him the dumbest questions lol and right after that they showed your vid.
