Licensing a video

hey guys

i have gotten two offers to license one of my videos, and i've read through one of the contracts and all, i was just wondering what you guys think of licensing and if there are any reasons why i shouldn't? each also offered to buy the rights at a higher price but i am firm in keeping the rights of my own video

ive had offers before as well and what they asked for was to purchase the one time rights to the video. You could sell them the right to use the video when ever they want to but you still have all the rights as well to do what you want with it. It all comes down to how the contract is written so make sure that you understand every single part of it and get them to clarify what everything means if you have any concerns with what they mean when they ask if they can purchase the rights to it.

i am definitely not selling my rights. both contracts are "non exclusive footage rights".

I'm curious to why you're so hellbent on keeping the rights to your video. Why not charge them a fair price so they can use it for what they want and not have to deal with one-time licensing? It's not like you're selling your soul or something.

idk, maybe it is just me but there is something about not having legal rights to something you created that bothers me. He told me that if i were to sell it to him that it would needed to be taken down from youtube and even possibly here, where i got over 50k views in a day. To me thats not something worth losing, but i am not looking at in on the financial end of things. agree or disagree?

of course! ha i went on youtube and saw it only had 2k but 55k on NS? that shit cray.


Just negotiate with the buyer, tell him you will sell him rights but you want to keep it up, etc. but if you do give full rights you damn better charge him for it, dont fuck yourself.

haha right? its because i posted it on here first, and EVERYONE took the newschooler embed link versus the youtube one.

I still am going to think it over, but when it comes down to it I want to have the rights and in my opinion thats how it should be. Still waiting on a some responses first.

Don't forget to put a time limit on the license. Very important.

e.g. Charge a $1500 for a 1-year license. After that time period, contract is expired, done deal. But make sure you offer them a renewal plan, say $800 for another 6 months or another $1000 for another year (1 year plan saves $600). This creates a win-win situation because by that time your video is likely going to be outdated (that's how video works), and they'd be better off hiring you to make a new one from scratch for a higher price. If not, they relicense and you get $1000.

alright, makes sense

are you talking about actually selling my video to them, or a non exclusive rights contract? because we have been in talks about a non exclusive license so that i can license to more than one company. I would rather do that then legally sell my rights to my own video.

Non exclusive, always. Unless you're getting paid an absurd amount of money, always do non exclusive.

A little new to this...but is there any way that you could have them whip up a contract that allows you to licensee the video to whom ever else you want while still keeping personnel rights for self promotion and such?

Might be a long shot but could be worth trying.

that is the point of a non exclusive license. i give them the permission to use and promote the video however they chose, while i still keep the rights to the video

Well, its really not me who is skeptical. The skier, Elliot, and one of the kids that helped with the bungee keep thinking (wrongly) that this is a one time deal and only want money out of this one deal. They don't understand the logistics and are being stubborn.

But bottom line is that it will be licensed.
