Alright so the other night I got a DUI, I turn 21 in 6 months, I blew a .007, off of 2 beers. I was high as well, and the cop cited me for both alcohol and marijuana.

any advice on how I should approach my court date?
i've heard of a Plea in Abeyance, but several people have told me to not do it,

legal advice much appreciated.

ya i dunno man, i'd just roll with the punches, but the fact that he tagged you with a .07 is pretty stupid. try to explain the beers were over a two hour period or something cause that is pretty hanus.. good luck

sorry man, but both of my parents are lawyers and they've had cases like this in the not too distant past. the best thing would probably be just plea and see if you can get out of this with a fine but don't be surprised if you have your license suspended.

he pulled me over for not having my license plate lights illuminated, and i blew a .007, which is like mouthwash. most breathalyzers don't even go that low.

are you ten? first if it was in fact a .007 thats hardly even intoxicated at all. and .07 still isn't bad and had he been twenty one he would've been legally allowed to drive himself home. To the OP this sucks major dick only thoughts is take the dui take a few alc classes they can suspend your license til your twenty one which is in a few months or fight it if you can afford it.

yeah in any state i know of a .08 is the legal limit so you would be under if had you been 21+. although idk about the weed factoring in because that's a dwi regardless.

anyway, contact a real lawyer, try and poll as many people as you know who have gotten DUI's before, hopefully somebody on NS will PM you because i'm sure you're not the only one.

isn't zero tolerence up to .01? in NY i believe there is a .01 leeway just becasue of other stuff.

plead not guilty at the first hearing.  then they can appoint you a public defender and you can still end up pleading guilty later.

i dont know you personally and have never seen your posts before so its nothing personal at all but i do hope for the sake of humanity you lose your driving rights for atleast a year and for the next 3 years you need to pay grossly inflated insurance rates. There is simply no excuse for what you did, you are not a child anymore and it might be time to "face the music".

i didnt look it up but cant you blow a .02 legally if you are over 18 but under 21? or is it .00 if youre driving?

they were probably more citing the marijuana if they bothered writing down that you blew a .007 which wouldnt be picked up on most breathalyzers.

save your money and hope that you can do community service and a program to get it cleared. i blew a .06 as a 19 year old and was fined $300 and i was in a car with a designated driver who blew zeros.

After being at multiple accidents that involved stoned or drunk drivers. I have absolutely no sympathy for intoxicated drivers.

But until these stupid kids have seen what a dead 7 year old boy looks like on the side of the road, it will never sink in.

exactly. some kids even try to go out on a limb and say "being high does not effect my motor skills so driving is normal" but the fact of the matter is they are stone cold wrong. There is nothing that can be said of how ignorant intoxicated driving is, and for some people for it to click in their selfish minds it requires a life changing event for themselves or the life of an innocent person. I would enforce mandatory time in prison for intoxicated driving penalty if i ran the country.

Although the judge may want you to take responsibility for it and this could be seen as you being in denial about the severity of your crime.

You're wrong. Sure if you are a non-consistent smoker and you get "too high" you'll have trouble paying attention. A regular smoker will have no qualms or adverse effects while driving. Thats it. There is no argument. It's fact.

I drive high everyday. I have never gotten a ticket ever. I have been smoking since before I was driving driving high is just driving to me. Not one ticket, not one accident, I've never even been pulled over. Maybe if people started blazing while driving they'd be in less of a rush and mellowed out and that would save lives. I gurantee the people who get in accidents while high are not paying attention due to an outside stimulus dropped phone changing cd's on a phone. WHich are honestly huge causes for accidents no matter if you're high, drunk, or sober. I'm not trying to be a fuck, because I'm not, and I'm not a fucking retard. I'm just saying being high doesn't effect your driving.

the only fact here is that you are an imbecile. You give weed smoking advocates a very bad name. You are trying to argue against the physical effect of thc consumption which has been proven over and over to suit your personal standpoint. I have smoked more weed than you can imagine in my life already, and still firmly feel it has no place behind a wheel a car.

If you are so sure, why dont you pull up a list of the side effects of weed smoke ingestion and see what you come up with. You are a true scholar.

Just plead guilty. Take responsibility for what you did. I recently got a DUI as well and thats what Im dong. And even in your case with a level that low the judge may see that you are taking responsibility and give you some leniency.

Other than that set up a meeting with the prosecutor and try to negotiate a lesser sentence so atleast you wouldnt get a criminal charge or anything like that. Good luck

I don't like drunk driving, but cmon weed doesn't make you lose control. I've driven with quite a few high drivers and driven high myself, it's not a big deal, I think you even focus more on your driving. I'm way more worried about the fuckhead soccer moms on the phone sippin a latte then I am about some guy who just smoked a j. There are some just plain scary drivers that aren't on anything, they're just retarded.

As a firefighter for 6 years, who has responded to MANY car accidents (see post above). I can guarantee you 100% that weed affects your driving and especially your reactions.

Well the first idea is wise...
The second, not so much. You would spend more on a lawyer than what the fine will be. You'll get your license suspended for probably 30 days, give or take (depending on the judge)and get a fine. Just keep your mouth shut as much as possible.

When you are high you are either lazy as shit and drive slow and stupidly or just juiced and drive fast and like a fucking racecar driver. But wouldn't be a DWI because of the weed and low alcohol content or is that the same thing as DUI in police lingo?

Hey pal I'm not some fucking retard 15 year old I'm a 19 year old college student at one of the best universities in the country. I'm also not going to get into a pissing competition with some gear head fuck, that'll get a bigger boner from posting pics of his money pit of a shit car, than a girl with her tits in his face, about who has smoked more weed than the other. Which I'm sure is me. Obviously if you smoke so much and more than myself, which again is very highly unlikely, we both know what weed does to you. Also, we both know that over extended periods of marijuana use your tolerance is built up to a level where you become a very highly funtioning marijuana user. I smoke 3 to 5 times a day on average and I drive from place to place and get by just fine no matter how much I smoked. Am I advocating it? No, I'm not, but what I am saying is that marijuana will hardly affect your driving skills if at all. If someone got in my car and said "I'm going to drive and the entire time i drive i will talk/text on the phone." I'd say fuck no you won't I am not driving with you. However if someone said I am going to drive you and smoke a blunt to myself the entire time I drive you. I'd say lets go be sure to use your blinkers so you don't get pulled over for and charged for possesion. You obviously don't smoke as much as you say and I'm sure plenty of people would agree with me. Oh, and also, if you look up effects of marijuana on people it says hallucinations. When was the last time you had a hallucination while smoking? Never and if you say you have I'd gladly call you a liar. So when they say you can't keep your balance or drive a car I'd equate that to them telling me that you'd hallucinate if you smoke a J... It doesn't fucking happen when was the last time you got so high you were falling all over yourself like you were drunk. Oh wait probably never since you smoke soooooo much more weed than me. Again go fuck yourself you don't smoke more than me. SO again go fuck yourself. If i see you on the road in your gay ass car I'll be sure to blow a fat cloud of blunt smoke at you and coast off into the sunset with my lights on (preparing for when the sun goes down), tail lights working, and going two under the speed limit. Well I agree it affects your reactions, it's just to me it's not a huge deal. I don't think it's as bad as someone who's just a really shitty driver. Other distractions like cell phones or eating or flossing or all that dumb shit are worse in my mind then being high. I don't see the point in enforcing high driving when there are sooo many worse shitty drivers who aren't on anything illegal.

Hahahahahah so funny. I could see a cigarette being a more harmful thing to smoke while operating a vehicle. Ive been stoned probably 75% of my time driving, and usually drive better . Marijuana affects everyone differently, plain and simple. Anyone who argues with me is wrong. IM RIGHT EVERYONE!!!!!!!! but many can function 110% better while stoned and some smoke 5+ times a day which gives a tolerance/lesser effect.
