I had a legal issue with a whole corporation. Is it possible to sue a whole corporation?

under FRCP rule 17(c)(1) a minor or incompetent person will need representation in order to file suit.

If though chooses not to acquire representation, then under FRCP 17(c)(2) you will need a parent or legal guardian to file suit on your behalf.

a corporation is a person under the laws eyes.

however you are not suing the "people" (IE the owners) you are suing the corporation. its own entity.


however, if youre asking for this sort of information on NS, then dont waste your time.

Well, back in april when there was still snow and ice I slipped on this corporation's walkway on the way to the smoke shop (I was going to buy a new grinder) next door and thought I was fine until now I realize my back is killing me and I am attributing it to the fall. I want to sue this corporation for not icing their walk ways for lots of money because its really hurting now.

was it foreseeable on part of the corporations part that people would be falling and hurting themselves on their property?

a better question at this point would probably be to ask who owns the property? who is responsible for maintaining it? (city?)


although, there is an assumption of risk on the walkers part. IMO

How exactly can I do that? The doctor said I pulled my trapezius and latissimus dorsi as well as slightly moved one of my discs which is causing the pain.

must establish:

1) a duty by defendant to clear the walk
2) a breach of this duty
3) an injury occurred
4) that the failure to perform the duty was the proximate cause of the injury
 

and also you will need to prove that you were not contributorily negligent, like, cause, ur a dumbass

you got  a case little man.  good thing u went to the doctor.  now get off NS, go on Google, find the appropriate chapter of the American Bar Association for your area, go to their website, go to the directory, and search for Personal Injury Lawyers. 

Find one who will give a free consultation/no fee.  You may be able to get a little money out of this after all.

Slip and Falls are classic out of court settlement cases if the facts are right.  Places of business have a duty to clear walk ways of snow and debris in a timely fashion.  If this was during a snowstorm, or right after, this wont work.  but if that snow had been piled up for weeks, or the ice was thick, then yea they fugged up. 

just cause this kids an idiot doesnt mean we can call the 70yr old woman who slips and breaks a hip and idiot too.

get off NS and seek a professional if ur serious

Yeah well the doctor said that lots of times the injuries I had were attributed to ice slips. That backwards slip. So thats my guess.

Thats awesome that you took Business Law.  Let me guess? They taught you Business Law right?  This is Personal Injury, so you bring nothing to the table.


Dont listen to these haters little man (although ur an idiot for coming in here and talking about this and probably deserve it)  you have a case, now write /thread, get off NS, do a little research for some local help, and go get the measly couple thousand bucks ull get from this place.  then give half to your lawyer, and then half of whatevers left to uncle sam.  then take the 500 thats left over and do whatever ya want with it! party!

I'm sorry, but America is the only country in the world in which you can hurt yourself in some complete fucktarded way and be able to strip a company of millions just because they had their name on the coffee cup and neglected to put "Careful, this is probably hot!" on the side.

Fuck frivolous lawsuits. US courts gave $14 Million to a woman who was hit by a subway train while trying to attempt suicide by laying down in the tracks. Its not rectifying the problem or teaching anyone a lesson, its raising my insurance premiums and taking money out of my pocket to pay for these retards.

correct me if im wrong (likely the case)

number 5 would be that he suffered some sort of hardship / loss of something? IE compensatory damages VS punitive. suing to have your medical expenses / loss of work (probably not the case here) is one thing. trying to milk a corporation because they have deep pockets is another.

negligence cases have 4 parts, i have listed them already.

the hardship/loss is the injury.

When I was 17 I contracted bacterial meningitis, almost died, and developed a non-curable disease of the central nervous system. A year thereafter I was a myster diagnosis, and was mis-diagnosed NUMEROUS times and put on thousands of milligrams of the wrong medication everyday. I will be sick, and in pain, every single day for the rest of my life.

Did I sue? No.

When I was 18, I was jumping on an unsupervised trampoline at a camp I was working at and dislocated my back. I had to be airlifted to a different state, and luckily suffered no spinal cord injuries but have had back problems since.

Did I sue? No.

I could name MULTIPLE other instances in my life where I could have sued that were 100 TRILLION times more legitimate than your stupid bullshit reason. In my mind, you are nothing but a lazy worthless piece of shit THIEF.

that came off a little mean.  i apologive.  punitive damages are only available in cases of GROSS negligence where there has been a jury trial and the jury has been instructed by the court that they may, if they feel so inclined, award EXTRA damages (beyond compensatory for the injury) in order to PUNISH the defendant for their wrongdoing.
