I got pulled over about a month ago for not having an inspection sticker on my window. It was about 8 30 in the morning and the cop smelled alcohol on my breath from the previous night, asked if I was drinking, I said yea, blew a .023. The legal limit for a minor (I'm 20) is .02 but he let me off with a ticket n said I wouldnt even have my license suspended. No Dui, dwi or underage either because I was honest. Guess what i get in the mail today.... A letter from penn dot stating I will need to hand my license in for 3 months. This not only fucks my summer/ social life, I won't be able to mtn bike, which means a lot to me. If your still following, I'm wondering if I should appeal the revocation (already paid the ticket) because the officer specifically said I wouldn't have my license taken. I'm also not trying to lose n be stuck w a pile of court fees. Another question i have is, would the judge not even consider my appeal because I was a minor with alcohol in my system while driving....sorry for the long read but I do appreciate good advice. whats the worst they could happen if you appeal and lose it? worst case scenario you'll be in the same boat you're in now

@Ryan there is a .02 in most states just because certain over the counter meds and some other things contain alcohol. Correct me if I'm wrong

i know you don't want to hear this, but I'd take your beating and move on. You aren't going to win if you appeal it. PennDOT are a bunch of fucks and they're ruthless when it comes to alcohol related offenses. i had to spend some time in LCP (Lancaster County) because of a minor offense. i'm pretty sure i can't drive in PA to this date. Fuck that state.

Really the only way you'd be able to refute anything is if you still have a copy of the ticket and it says, again, on the ticket, that you were under the legal limit for a minor, and that all you have to do is pay a fine, with no court appearance or other ramifications. You can't just say that the policeman said he was "letting you off with a .02" without evidence that supports it, particularly if you were above .02. You could try to refute the accuracy of the test (I wouldn't if it was a blood test, breathalyzers are somewhat less accurate, but not much)

how far do you live from Canada? cause if you're close there's always the "I was across the border for some drinks" card. but I do not approve of lying. just stretching some fact to get around a retarded drinking age.

Court fee's arent that bad... I dont know about in the states, but Im currently going through the ringer for a DUI a little worse than what you got, but I mean in your situation you could def. defend yourself so you wouldnt need to get a lawyer. And if the ticket and cop SPECIFICALLY state that there were to be no license suspension you should be set, because in court they will have the cop present so yeah...
Hope your shit gets settled, Im on my 8th month without my license and it blows hard, def not worth it one bit.

This might seem really stupid, but is taking alcohol through your anus considered "drinking".
as in, if you do an enema (is that how you say it?) is it still considered to be underage drinking? (obviously if you are underage). because they're specifically called "drinking" laws. so I wonder if you said you got drunk through putting it up your ass hole if they technically couldn't charge you.
I'm not trying to troll or be dumb or anything, I'm legitimately curious

you can blow up to a .01
that means, after a sip, yeah your getting a ticket...not too helpful if you ask me, but thats just my opinion.
