Here's a little circumstance

Lets say it's 1am, and you here a crash. You grab your gun, go downstairs and find an intruder. He threatens you with a knife.


Is it OK to shoot him?

from what I understand, it's still illegal and you can still be charged.

Opinions?

if he's in my house with a weapon i'm definitely gonna protect myself, id prob shoot once over his head to try to scare him off but if he keeps coming at me then id shoot him.

I don't think so. I think it depends on the state. I saw an article last year about a guy who's place was broken into and he killed the guy with a samurai sword..but they had to prove if his life was in danger or not.

It should be 100% okay to shoot and kill him.  If some jerkoff is trying to break into your house, he should feel your wrath.

thats probably true. in Ohio i know if they're a threat to you or your property you have the right to defend yourself. personally if someone broke into my place id shoot first and get into the legal technicalities later

In July '06 Michigan (MI) enacted legislation that clarifies when a person can use deadly force in self-defense during break-ins, car jackings, and other violence outside of the home. The law makes it clear that when attacked that a person need not try to flee. The law also shields the defender from lawsuits by the attackers and their families.


You break into my house and I have a gun, you're dead.

its 100% illegal where i live, as far as i'm aware, but i'm from the uk (someone correct me if i'm wrong). and besides i'd be stabbed to death by the time i went downstairs, found the keys to the cabinet, fumbled my way through the hall cupboard in the dark, opened the cabinet, got my gun, put it together, found ammo in the dark, fumbled out of the cupboard again, then confronted said intruder :/

From what I understand, any shooting would be a homicide. Depending on the circumstances, it could be a justifiable homicide.

Yup. There was an incidence down my street a few years ago where an ex husband broke into his ex wifes house and her boyfriend shot the ex husband. I pretty much live in the hood

The law can be messed up a lot, and vary widely state to state. You're best bet is to yell a lot to let him know you are armed. Point the gun when you see him, and order him to the ground if he doesn't run away. Then just wait for the police to get there. If he charges you, I would probably fire to injure, but not kill. Then still try to hold him there until the police arrived.

yea let him go, atleast next time he'll think twice about messing with someone house.
also if you shoot him in the leg he can still die from massive bleeding if you hit the arterie.

If you shot him while he was running away you would be fucked. it would be obvious that it was not self defense because you shot him from behind.

there cant be a country where its legal to shoot anybody who is trying to run away from you.

depending on countries/states, you can only defend yourself. if someone doesnt have a knife and is breaking into your house, and its obvious that he is unarmed, i think it should never be legal to shoot that guy.

its something called inappropriate violence (at least in austria).

you cant use potentially lethal gunshot to stop someone from stealing your shit.

i am pretty sure that this is the same for most western countries. just imagine a 15yr old kid stealing your laptop and its obvious that he is unarmed and in now way a danger to your life. it would be fucked up to shoot him. you are not the fucking police, its hard to grasp for certain americans i guess, but police stuff should better be done by the police

just because our judicial system is so fucked up, youll probably end up being thrown in jail. A family friend lives on a boat in the summer, a guy broke in trying to steal shit and the family friend stabbed the guy. The guy had a gun on him, but did not brandish it so the family friend is now serving a 5 year sentnece or something like that for attempted murder. The government sucks

depends on the state. in colorado once a person illegally enters your home (or vehicle) you are authorized to use lethal force and have 100% immunity from prosecution and any resulted civil suits. my neighbor was held up at gunpoint in her house last year. i sleep with one of my handguns loaded up with hollow points on my nightstand and you better believe im shooting first and asking questions second.

In any state where it may be illegal, most judges would just dismiss the case anyways if you killed an armed intruder in your own home.

I had a buddy in socal who's team mate was attacked on the street by 2 guys tryin to rob him, he stabbed the hell out of one of em and killed em and the judge dismissed the case saying that since he was under attack by more than one person the use of lethal force was okay.

I would prolly just shoot him in the foot or something. Although im pretty sure if you had a gun you would have no problem talking them out of trying to attack you. And im sure if someone is trying to stab you in your own home you can shoot them lol.

I think the real question whether to shoot or not is, is he really a threat to me and other people in the house or just carrying the knife for intimidation(robberies). If you're not totally sure then just run to the closet and ask ns for advice.

I would find that completely justified.

Texas has the castle doctrine.


But in the world these days everythings so fucked. I could cut your security system, ignore no trespassing signs, break into your house when you're on vacation, fall down the stairs or get bitten by your dog then sue for 100k and win.

Any judge that lets that kind of shit fly should never be allowed in a court room again. No exceptions
