Who was wrong

ok so today at breck on jump 2 in park lane. i did a shifty 5 came over the landing and saw some kid who yard saled(sp?) and my feet kind of hit his arm in mid air. i did like 4 flips, fuck my head up and i think i bruised my tail bone the kid i hit just had some pain in his leg. were both ok but i was wondering if some one did get really hurt who would be the one that would of had to pay for the bills

probably none of you, cause it was an accident that couldnt have been avoided. You could not have known there was a guy in the landing, and he fell. thats my opinion though

that sucks man it all depends if someone was makin a closed sign or not cause if you had no idea he was down there, then theres nothing you could of done

you. its fucked up but ski law is "look before you leap". you should have had a spotter in the courts eyes.

though common sense would say that when you yardsale, you should hike up the side of the jump to the top to make sure no one is dropping then go get your shit.

Not sure this is entirely true. 

National Ski Patrol Responsibility Code

  • Always stay in control, and be able to stop or avoid other people or objects.
  • People ahead of you have the right of way. It is your responsibility to avoid them.
  • You must not stop where you obstruct a trail, or are not visible from above.
  • Whenever starting downhill or merging into a trail, look uphill and yield to others.
  • Always use devices to help prevent runaway equipment.
  • Observe all posted signs and warnings. Keep off closed trails and out of closed areas.
  • Prior to using any lift, you must have the knowledge and ability to load, ride and unload safely.
The third could be argued too.  Basically, as shitty as this sounds, it depends on who has the best lawyer.

ya b ut look at the "Smart Style" rules that you see posted in every park, and on the parks website. It always says "look before you leap, use a spotter"

Are there lawyers involved? It sounds to me, as shitty as it sounds, you've got every rule working against you.

Downhill skiers have the right of way, watch for downhill skiers, etc... none of them really matter much in the park but you've still gt the big orange signs telling you to Look before you leap.

The only thing looking up for you is that you were in the park and there are different rules. The rules are much more flexible though because you do have the "Enter at own risk" sign in your favor. It's the park... things happen. If the guy's got a lawyer then get a lawyer. Talk to ski patrol cos they'll help you out with any argument you can use.

if the kids were bitches, it would come down to who is a better lawyer, but this is newschoolers, not faggot lawyer america, so you guys would probably just be like whatever such is life... some guy got hit by a car in the lot in summit a week ago, didnt sue,, wasnt even that mad... welcome to colorado, accident lawyers get the fuck out

I guess it would depend on how long that kid was sitting there. Your supposed to get your shit and get out of the landing asap when you crash. Its pretty unavoidable though, shit happens.

yeah you got me that was the whole point of the thread i wanted everyone to know i can 5 a 15 foot jump, and no i said above no one is doing anything i was just wondering.

these rules have almost zero hold up in terrain park.

a ranger cut in front of me on the landing of a box and i almost hit him and he tried telling me he was wrong after going through a screaming match on the hill and him telling me to kiss his ass and then me telling him that when he bends over i am going to shove his skis up there we went to the ranger room where it just so happened that the president of the resort is at the time so we explained everything and after wasting most of my wonderfull day i was right and he actually got a nice bitching by his boss for not knowing the rules and telling me to kiss his ass.

so just be happy that no one got hurt and you could have been in trouble if the person had a good lawyer since smart style says look before you leap and always have a spotter.
