Underage sex on a birthday - she turns 18 during the act

I was wondering, how would this fly in a court of law? If the age of consent is, let's say 18, you end up hooking up with someone on their birthday and begin the act while the person is 17 and finish when the person has turned 18.


I'm intrigued. Of course, not in support of sexual abuse of children through legal issues, but don't you think it is kind of funny in a way:

17 years and 364 days - DON'T EVEN THINK ABOUT IT!!!

So there would be no legal lashback if for some reason everything went down shit creek later on and she would try to file a suit against you for sexual abuse of minors when it happened?

Is it really just at midnight or the actual time of birth i.e. 4:23 AM?

certain jurisdictions have ways around this problem. in australia, for example, the legal age of consent is 16. ie. its illegal to have sex with someone under 16. however, there's an exception if you're within two years. so if your girlfriend is 15 and so are you, but then you turn 16 there's nothing wrong with continuing to have sex. you wont get in trouble. the obvious exception is for teachers and people in places of authority, where its still illegal to have sex with someone under 18 or in your care. (for that case with two adults where one is a coach or lecturer at university etc they have to make the relationship public and take all reasonable precautions to make sure the relationship doesn't interfere with the professional aspect of it).

I assume the states would have a similar arrangement. while the legal age of consent in your state may be 18 i would be very surprised if the cops arrested you for having sex with your 17 year old girlfriend. especially if you can prove there was a preexisting relationship before you turned 18 yourself, although if i were representing you id argue that's irrelevant and that the moral aspect of your sexual relationship shouldn't be called into question.

long story cut short, make sure you come on her face. then change the clock to 12.05 before she can see anything.

im pretty sure it fine as long as ur both in school.  You get introuble when your 18-19 and out of school and she or he is in high school.  Even if one is in high school and the other in collage im pretty sure its ok.

i would say as long as she is 18 by the time you penetrate.  just make sure the foreplay lasts long enough until she is of age.

plus, as eheath said it doesn't matter unless charges are pressed.

You become a legal adult at midnight the day of your birthday, it doesn't matter when you were born.

Also, these cases are decided on a case by case basis so theres definitly a gray area.

And statutory rape occurs when penetration happens.

So yes it would be considered statutory rape if penetration occured while she was 17 and you were older (general rule is its okay within 4 years but then again even that is case by case) even if she turned 18 during the act.

On a side note, if its consensual than your pretty much good assuming your within an understandable age-range.
