Basically I got caught in the wrong place at the wrong time and was issued a ticket for minor in possession of alcohol. I had 2 beers and really don't think that's worth the $230 ticket I was issued, so I'm planning on disputing it and banking on the fact that the cop won't show up to court. Has anybody ever had any luck with this?
Pretty sure, at least in most states, that the 'cop didn't show = tix being revoked' is a rumor.....I'd count on going well dressed and talk to whoever in a respectful, apologetic manner and i'm sure it'll be decreased to community service or something.
My roommate got one out of state, got a lawyer, and ended up having to fly to that state for court because the judge had a vendetta against underage drinking. He's on probation for 1 yr, and had to pay like a $300 ticket.
You have no grounds to dispute the ticket... don't bother clogging up the courts. You drank underage 2 beers or 25 you are guilty you admitted yourself you drank.
ok assfuck, firstly i said i had 2 beers with me, that i was not drinking. no open liquor. secondly disputing the ticket can get a reduction or if the cop does not show up i can get the ticket erased. why not try? i made this thread looking for people who had first hand experience with this sort of thing, not some dickhead with a condescending attitude telling me not to clog up the courts. and yes for a minor in possession of alcohol $230 is retarded expensive. before 2010 they were only $59.
My buddy just put off his court date for a long ass time. Then he got arrested at his house, but he only had to pay like a $50 holding fee and apparently they dropped the MIP or something. I dunno how it worked honestly...
i got the exact same ticket as you in september,i kinda forgot about it and i still havent paid it. im not sure if you can dispute it, if i were you id probably pay it soon while you can still get $25 off
I got a $150 ticket for fighting on public property (at school, didn't start the fight), and I'm gonna try and dispute it. I just wishing that the judge has some brains or the cops doesn't show up.
Jason, did the place where you go to dispute the ticket tell you that they make the court dates around the cops work time?
i swear some of you new kids on this site are the biggest twats ever. are you really gonna tell this kid what he did was wrong and he broke the law and deserves to pay the ticket? FUCK THAT you guys are so fucking lame!
He does deserve to pay the ticket. Boo fucking Who its $230. Pay the fine and learn from it, as in don't get caught. The only reason kids under the age get caught is because either they are being stupid or someone they are with is being stupid.
cops usually dont show up to little shit like that. ive heard it go both ways tho, people have gotten off due to no show, others have sat around for 2 hours just to end up being told they still have to pay.
I'd go for it, you'll probably get it reduced. lots of the time cops will hand out ridiculously pricey tickets and most of the time people will just pay them. 230 is way way too high for that. unless it's an infringement that has a set price of 230, in which case you won't get it lowered. but the fact that you didn't actually drink and only had 2 beers with you, and if you're 18 or something, then almost certainly they'd lower it. and yea, in Canada at least for traffic tickets if the cop doesn't show you dont have to pay it. but for a ticket worth that much I'm sure they will show. it's mostly for the 20 dollar parking tickets they dont really give a fuck.
i got a ton of those in college. go to court and try to get a reduction on cost or trade for community service. if you opt for community service they usually wont put it on your record. 230 is pretty cheap tho. mine were usually like 5 or 6 hundo.
See the problem though is what if he was a broke college student like I am. How am I suppose to pay for something that expensive? Better yet why are the police issuing tickets for what a majority of college kids engage in? We should get some sort of compensation for having the maturity to actually go to college. I guess I just have a big problem with our legal system. IT SUCKS!!

just show up well-dressed and well-spoken, make it clear that you're a broke student with a surplus of time and good heart, and the judge will give you community service.
Well, if you do go to court you had best be sure you're going to win the argument, as its a 250$ charge to bring it up in court on top of the 230$ fine, might be best to leave it.
worth a try. It's not a huge ticket, but no one wants to pay that. Just inconvenient.
I assume if you appeal and get a court date, you'll still have to pay some kind of court fee, regardless of whether the ticket holds up or not.
As for the cop not being there...I wouldn't completely bank on it, as usually court dates are scheduled so the same cop has multiple appeals on the same date so they actually go. But otherwise you don't have much of an argument.
I say go to court. I've had friends go to court to fight a DUI and get off because they "didn't have time" to deal with the case due to other shit going on in the courthouse.
I'd say, odds are the cop won't show and you'll get off.
I have an unpaid jaywalking ticket in Alberta. I just ripped the ticket up after the cop gave it to me. I probably have a warrant out for my arrest in Alberta, but I made a promise to myself to never stop foot in that god awful province again, so it's like, whatever, you know?
I have a few friends fighting drinking in public tickets right now due to some asshole cops during Winter Carnival here in Rossland. Stupid cops.
what were the circumstances in which you were ticketed. you can sometimes make up a believable story. For example getting caught with an open container-you were picking up the can some one had littered and were in the process of finding a garbage can...etc.
But it cant hurt trying to challenge the ticket, worst case is you waste some of your time.
i contested aticket for .022 and got off the cop showed up but the judge said the margin of error for breathalizers are .005 which would have me at .017 and .02 is the limit. i know right asshole cop gave me a ticket for 2 thousandths over the limit (2 hundreths for under 21)
