it costs 80 bucks or so to even open a case in small claims with is a 3rd of the money he owes you haha. definitely charge him another 30 bucks for a bounced check though. id say just wait another week or so and see what happens. if nothing, take his ass to court. get him to pay you the bounced check fee, the court fee, the original money, and "damages" for lost wages/time.

There isn't an official contract.

Just e-mail and facebook messages. Yes he is that unprofessional that he uses facebook as a means to chat vs. google chat, and other conventional methods.

But everything is documented in the sense that, he is contracting me for design work. Then i have e-mails from him admitting he owes me money even, and then saying he is trying to go to the bank to get it, but the ATM might not allow him to withdraw more than $100 a day, and EXCUSES EXCUSES EXCUSES.

He's offered to pay with check or paypal, and im like fuck that. Paypal you will dispute it and make my life hell. Check will bounce again.....

I insist on cash and hes just being a fucking bitch about this situation.

Im thinking of sending him a nice scare-a-gram. My work sends out these forms to customers with over-due amounts and they are from the court house so they look scary in the regard that if you don't respond by a certain date you are going to court or something.

I wish I knew was it was called, but they always get our customers to call in frantically trying to resolve billing issues at my work.

This company is all a farce for this guy. In other words, its a fun thing to fail at. He has sold nothing, the funding he gets is probably from his oxycontin prescription that he gets from a collapsed lung that is such a re-occurring problem for him.

I literally want to just beat his ass, but that wouldn't do me a bit of good with the law, or getting financially compensated for just time and hours wasted.

The only thing I can say is...he is great at being hard to find. I have stopped by his house twice, once no one was there. Second time his girlfriend and supposedly not him. I gave her a letter that has a nice official state looking document scare-a-gram that my work uses. She looked nervous and startled that I would show up and just be like hey...wheres he at? how can i get ahold of him? and she was just nervous as all hell like omg i cant believe this.

He documents his worthless life on his facebook business page well, and he accomplishes a TON of nothing, and in the end he has from what I gather, zero business. He has been in business almost 1 years and I don't think he has made one sale for his business.

Put it in to perspective, I call...his business, and for the last 3-4 days its been an answering machine, during "business hours".

This guy is so shady, having my name associated with him is bad news.

Yeah let me summarize again;

1) 8/26/10 - $260 check was wrote
2) 8/31/10 - $260 bounces, kid claims it tried to go through for $2600. my bank said, wtf no, non sufficient funds.
3) 8/31/10 - decent amount of contact claiming he was going to get things ALL settled and hey I could even come by after class and pickup the cash! Not bad
4) 8/31/10 7:10pm - Message from him on facebook from his girlfriend (claims to be), "his lung collapsed again, we had to take him to the E.R." (yeah thats why you are on facebook.......and why couldn't he leave the cash with her if shes at home on his facebook account)
5) 9/1/10 - avoidance all together
6) 9/2/10 - promises to pay me that day and that hes up and moving and able to get to the bank and will be TOTALLY READY to pay me after a site visit I had to do from 1-3pm that day. All contact has been through e-mail and facebook at this point. Him staying off facebook chat, yet sending facebook messages (dumb...those things are actually logged vs. chat which is not, if he wanted to try and avoid everything being on record), and e-mail. Will not pick-up his work phone during normal business hours.
7) 9/3/10 - avoidance all together. i got some official looking papers from the state, that in the end are not official in the sense that you are going to court, but it identifies me as the plaintiff and specifies who is going to court over what and over what amount, and details about the limits of small claims court, and I drove over to his house. His girlfriend was about ready to shit her pants when I walked up and started questioning her. Saying oh i have no idea, hes at some girls house right now.I ask if hes been avoiding me and she says Oh no I would no too, because I have to drive him everywhere (did I forget to add that he has no license, no cell phone, and what I think is an addiction to opiates from his supposed lung issues (dont forget he smokes cigs like a chain smoker too)). Then shes like im actually kind of mad at him myself right now because he took the car. Oh MAN I should have been recording that conversation, because that would be her admitting she aided in allowing him to drive with a suspended license, using her vehicle. I said well these are the small claims papers, tell him to contact me as soon as possible or we are going to court. Nervously she looks back and replies alright i'll get them to him.

That driving with a suspended license thing would have fucked them bother over criminally, on top of the civil charges that I would like to bring to court.
I have been trying to contact this so called "business" during normal business hours as stated by himself on his facebook page, and all you get is an answering machine.




If this all seems like one big fucking ironic situation then I encourage you to go sell seashells by the shore or some shit. Because at this point in time he has been presented with many chances to pay. On 8/26 I insists all transactions now be done in CASH. Now I have dealt with many financial institutions, some of them do have ATM withdrawal limits...of say maybe $500 a day. But he tries to use some excuse about how he cant go to a bank and withdraw more than like $50 or $100 a day or something.

Once again, all a bunch of bullshit, and more excuses.

He was like oh that was a big misunderstanding with bank of america, how about i write you another check? Fuck that man I don't want any more non-sufficient fund charges appearing on my account.

Now at this point I am willing to go paypal route. Because paypal DOES allow someone to pay someone using credit cards as a source. And on 8/26 he received I don't know, about a living room full of boxes from Office Depot, and on 8/31 he rented a limo, because hes just a baller like that, and he was so kind to post all these photos on facebook bragging about his limo ride.

I believe this guy exists only in the credit world, and forcing him to get a "cash advance" on his credit card and paying me through paypal (or get an actual cash advance I don't care and pay me in cash) is the only way I will likely see money out of him.

Im calling his bank and I am going to see if they will tell me anything here.

Bank of America says....bring us the digital copy of the check. If there is $260 in the account....we'll cash it. So I will find out right quick here if he is telling the truth about the $2,600 amount or the $260 amount.

Even if I do get the check cashed, he still owes me over a quarter of a grand....

Some other tid-bits. I was fixing his computer, and I had to reboot it...I noticed he was A. monitoring his credit score and paying for it. The only people who do this are well...financially well off people who monitor their credit score, identity theft victims, and people with terrible credit because they were in bankruptcy.

I also recall having to exit quickbooks pro, and quickbooks pro said like are you sure you want to close with a negative balance of $1,600 some odd dollars or something.

The guy is going to have a terrible life....end of story.

Oh yeah if you are wondering what did it. I contacted a police officer today to inform me of the procedures of what to do next, and it appears our state or county has this super swank and easy way to just criminally prosecute people who write bad checks for over $60, as well as take them to court in a civil matter over the amount owed.

So I presented him with the option of going to court basically, or abiding by a deadline of 6pm tonight. HE PAID UP THOUGH. JEAAA
