Well the constitution and the bill of rights survived that long, but those things arent that important.... maybe we should re-write them every time a new president is sworn in. Also, there is law from England and early American history that is still good law today that I read on a nearly daily basis.
I have read your other posts and you are really mistaken about how the framers constructed the constitution and our government. America was designed to have a very small government because the power was in each of the states. The federal government has completely taken the power from the states as given by the constitution in a way it was not intended be.

Nowhere in the constitution does it state that healthcare is a right. You can get on your moral high-horse and argue all you want that it should be, but its not a right recognized in America. Nor is healthcare a right afforded in the bill of rights. And as a matter of fact, in 1966 the Senate rejected a bill created by International Covenant on Economic, Social, and Cultural Rights (ICESCR) which tried to essentially make health care a right. Furthermore, health care was actually a topic discussed by the the framers, and I think Thomas Jefferson put it best "if people let government decide what foods they eat and what medicine they take, their bodies will soon be in as sorry a state as the souls of those who live under tyranny".
Now with that said, I absolutely think reform is/was needed. More people need to have a general practitioner they have easy access to rather than using the emergency room as their doctor. However, the best way to give health care to those who do not currently have it is DEREGULATION not this shit. Obama just took over 1/5 of our economy. The free market has always been the best way to reduce costs. Here is an example, the first cellphones cost thousands of dollars. Now through advances in technology (because of the free market) make cellphones affordable for nearly everyone. Yeah not everyone can afford the latest Iphone with the unlimited data package, but there are those damn cricket phones I always see commercials for that cost like $10 a month. Even a homeless person can afford that. (yes i realize giving medical attention to someone is very different than providing them an affordable cell phone, but the economic theories are still true). And we did not have a free market before this bill, not one bit.
The free market is why some foreigners (particularly Canadians) who can afford it come down to America to get their needs taken care of. Any of you know any military veterans? How good are VA hospitals? In case you dont know, theyre garbage. Quality of services rendered is terrible and there are waiting lists for everything. If they are fortunate enough to afford it, my bet is they go to their family doctor for better medical attention and get it faster.
Now if only we can look into the future to see how this will turn out..... oh wait we can just look at Massachusetts (as briefly mentioned earlier). Their State Treasurer, Tim Cahill, recently stated that the obamacare system "has nearly bankrupted the state". As if we weren't having enough difficulties with the economy, now this? But those in support of a health care system will be like "look now more people have insurance" (up to 97% in Mass.) Well thats fine and dandy, but what the hell is the point if they cant get in to see a doctor? Thats like paying car insurance on a car that sits in your garage because you cant fix it yourself and cant get anyone to your house to fix it. ITS A WASTE OF MONEY. Furthermore, health care costs have NOT decreased in Mass as stated by Cahill. Why would it on a national level?
Back to the legal side of things the constitution states that "the powers not delegated to the United States, nor prohibited to it by the States, are reserved to the State's respectively, or to the people"
Now clearly nowhere in the constitution does it give the government the power to take over the health care industry, and as of now 38 states are prepared to bring a lawsuit against the government claiming that the bill is unconstitutional because it violates the 10th amendment (famous for the commerce clause) by requiring each state's citizens to purchase insurance and places too high a burden on the state budget because of increases to Medicaid standards. All of these things should be, and have been, up to each state to decide.
There are some other really appalling stuff in the bill too, as if forcing citizens to PURCHASE (it isnt free) insurance from a PRIVATE company wasnt bad enough.

Oh yeah, cant just buy any old health insurance it must be government approved. Anyone want to bet against me when I say that the "approved" plans will only be provided by the biggest companies thus killing the smaller ones? (Anyone notice that the biggest health insurance providers stock's all rose today?) Yeah that sounds right, I want some government official deciding for me my options when it comes to health insurance......
But its not all that bad, it is estimated that this bill will create over 16,000 new jobs! woooo! ohhhh wait, its over 16,000 new IRS agents.... why? Because they will be sifting through your bank accounts and medical records (YOU WILL HAVE NO PRIVACY) to determine if you have an appropriate amount of health insurance. Hold on it gets better yet, they can seize your tax refunds, garnish wages, and will have access to your bank accounts if they think you should be covered differently.... hold...... wait for it.......... all WITHOUT a trial either................ OH JOY
And if it couldnt get any worse, illegal aliens arent subject to the fines OR taxes under this bill, but they will be covered though.
Yeah all that sounds constitutional..........................
