Anyone bought an itouch recently?

My itouch just broke and I'm only getting sound out of the right side. It's still under warranty but I don't wanna lose the ability to jailbreak with a replacement. What I need to know is, do the iPod touches ship wit firmware 3.1.3 right now? Do they even ship with any firmware I remember I had to download a firmware before I could use my iPod. I'd rather just deal with the sound out of 1 side then lose the jailbreak.

yes, i have bought an iPod Touch recently, and mine came with the 3.1.3, but if i were you ide send the ipod back for a new one, itl most lifely come with the 3.1.3 update but theres gonna be a jailbreak out for it really soon from what i hear, im not even going to jailbreak mine when it comes out probably i dont really see a point in it if i only use it for music really and doodle jump sometimes. but yeah if its screwed up getta brand new one for free imo

Do you even know what jailbreaking is? I'm not stealing anything none of the apps I got from jailbreaking have the same functionality availible from an app store app. And I paid for some of my jailbreak apps. And what's with all the itouch hate I know a ton of people who say/type that instead of iPod touch. All I wanted was a simple answer I didn't need all this douchebaggery.

They're going to wait on a jailbreak for 3.1.3 firmware because it's to small a change to waste an exploit on. For some iPods the 3.1.2 jailbreak still works, for others it doesn't. Supposedly the 4.0 firmware will be out relatively soon, so they're waiting for that. It's rumored that since 3.1.3 doesn't affect 90% of iPods, only ones with a small battery issue, Apple is using it to smoke out anyone who has found exploits.

Yeah I thnk i'm gonna take it to the genius bar this week (after I restore it to het rid of the jailbreak of course) I can't even listen to it in the car Anymore it sounds super gay coming out only oneside of the speakers I'll just live without pokemon yellow til fw 4.0 if I have to
