I got a upm (unlawful possession of marijuana) a couple months ago and when I went to court for it they gave me an acd (adjourned case dismissal) and I had to stay out of trouble for 6 months. The other day I got another fucking upm, so fuck... does anybody know what happens with this shit I have no idea?

this. there is no way to say that some of it isnt luck, but to get caught twice, you have to have a hand in it too. that sucks though man, luckily there has been a recent push to legalize weed, hopefully it was a small amount and you get a nice judge, id say probation tho

You wont get probabtion. a UPM is only a violation in NY, and you can get 3 within a certain period of time before they become anything more serious (ie a misdemeanor) Most of the people who are answering your questions probably arent from NY, therefore dont know what they are talking about, and every states marijuana laws are different. In NY it is decriminalized, so you probably wont get probation since thats a pretty serious punishment for something thats more or less equivalent to a speeding ticket.

What will happen is the original charges will be brought back, and you will be charged with the 2nd one as well. You will have to pay a fine, as well as a court surcharge (of course) when I got a UPM up north in Plattsburgh I paid 150 dollars and that was the end of it. My friend just got a UPM and paid 225. Chances are they will give you a higher fine since you have two, but I boubt you will have to pay anything over 300 per incident. Sorry tohear about that bro.

You might get lucky though and if you get a lawyer (even a public defender) you can probably get it reduced. I recently got a 2nd upm and possession of a controlled substance (adderall), which is a misdemeanor and both charges were reduced to one count of public disobedience, and I have to pay 275 bones, but I feel like I got lucky. So yeah, good luck in court hahaha

Since I dont live in NY I am not familiar with their laws but I highly reccomend contacting an attorney it is possible to get some free legal advice and even though it might seem unmanagable to actually higher them if you think about it paying around $1000 for an attorney might save you a lot of money in the future.

yes.... many people are unclear about what decrim means.... it doesnt mean its legal, its just not considered a serious crime and the state doesnt spend as much time money on enforcing its illegality. It's still illegal, and you can still get in trouble for it, just like anywhere else, but as logn as you dont have 500 UPM's the worst thats going to happen to you is a slap on the wrist and a fine. Hell, the judge probably smokes weed.
