Not bad of a one sided story from a 16 year old. Now I'd love to hear the police's side. But...you were underage drinking, had alcohol on you, had weed on you, and had paraphernalia on you. You got caught. Man the fuck up. And props to your parents for not babying you. fucking kids need to learn a lesson.

you can only get arrested for weed if you have like a quarter or more or 7 g or some shit, so they cant charg you if you only had 1 g, but they can search you if they catch you with weed or smoking it. but thats shitty man , i live in edmonton and theres been so much police brutality it snot even funny

dude im a prelaw major---- if you never gave consent to a backpack search its unlawful search and seziure , all contraband he found in your bag will be "dissmissed" in court because the evidence was obtained unlawfully. It may be pricey to obtain a lawyer but you easily have a police brutality report on hand. If you do in fact have witnesses you should have no problem thats fucked up a cop would slam teenagers head into a cruiser.

that sucks, but you should file a report, that is aginst the law big time, but get ready for a little trouble for the beer and herb but the constitution was put in place to keep the law in check.. and it is the governments (the citizens of the United states) job to do so

Yeah I wasn't planning on going to court, I don't think it's worth the hassle. And yes they took my piece (a very nice elephant shaped bubbler) and they took my herb. Only a gram though so not that big of a loss, still annoying though.

A simmiler thing happend to me.
On halloween actully.

Me and some buddies are chilling at a local high school around 8:00 at night getting ready to head up to the party. Smoking joints and drinking beers we were about ready to go. We see a cop pull up on the road, maybe 100m way from where we were sitting. We figued he would just keep driving, wrong. The two pigs got out and started runnign after all 5 of us. We grab the shit as fast as we can and book ass. We get away and starting walking down the street to the party, and guess who shows up behind us. The fucking police. His lights went on and he pulled us over, some people had backpacks, i did not. Just a mickey in my back pocket. They all had there backpacks demanded from thm and put on the hood of the car. The cop explains how he smells the weed and says if we give it up then the patty wagon will not be called and legal action will not be made. So i give up my joint which happens to be in the back pocket with my mickey. By this time theres 3 other cop cars and like 6 pigs. We all lost al our alchhol and weed and were sittign on the side of the street waiting. I was smilling becuase i was high off my ass. The cop comes up and says " why are you smiling" i said because i gave all my stuff up and i have nothing left" He tells me that im goign to get a lecture or a ticket, and begins to lecture me. His pig friend shows up with his ticket book and calls me up. Now i was scared because i had my beautiful 50$ pipe, and fireworks in my pocket. He makes me give all my information and gives me a 52$ ticket for minor in possession, but all my friends are let off scott free. Backpacks without alcohol were gaven back, same wth the ones with alcohol. Now the fucked up thing is as we continued our walk up to the party, they drove by and yelled out the window " next time share with your friends" as only half of us had alcohol.

Not as bad as frodo's, but its 52$ i wouldve rather kept.

Counter-sue for assault and harrassment.

Make him pay for abusing his power. You'll win easily with all the witnesses, and he'll have to pay your fees.

You should have said I do not consent to this search. From how you tell it, it makes it hard to decide whether you made it clear that you weren't giving consent.

If any of that actually went down like that I would get a lawyer.

Why? I'm not an anarchist, I support the idea of cops, but I do not in anyway support the police we have. They literally try to bust everyone with anything and tack on as much shit as they can. Sitting there all day getting there quotas of speeding tickets to make money for the force. Tailgating people. Trying to dodge around the law. Lying to people in cases involving searches. Cops are trained to be a specific type of person, and I have no respect for that person. They should be the best citizens. Not overstep their boundaries in anyway.  Be legit, like the old school sheriffs. I've seen so many dick cops, and even the "good ones" are just good in comparison to the real shitty ones.

They need to change the way it all goes down. That isn't going to happen though because there moving us in the other direction. Cops are gaining more control, the police force is slowly being militarized. Not a good situation for the future.

But if he didn't make it clear that he didn't give consent he might have given consent through something he said really. Cops can be tricky, and 16 years old get scared in the face of a dick cop sometimes. Plus they might have been drinking while walking or smoking a j.

Which brings up yet another point I have held off talking about. The OP stated that he had been drinking before this all went down. He never said it, but if the cops smelled the alcohol on his breath, all bets are off. Every right he thinks he had are now gone. And if OP wants to argue about this in court, all that needs to be said is that they were under the influence of alcohol, and they pretty much automatically loose any argument they had.

I drank 3 beers and had been coincidentally sucking on a breath mint for at least 10 minutes before the cops showed up. Not a chance they smelled beer on me.

That is not probable cause. You cant search someone because they look suspicious. He would have to claim that he smelled pot or something. This will never hold up in court. Get a lawyer and all charges will be dropped. Your parents will find out though which might suck if they aren't cool with that stuff.

might be a grey area
it could be circumstantial based on the party being broken up recently and an underage kid with a backback walking in the vicinity
a reasonable person would be suspicious that a "crime" was being committed
either way its a shitty situation and it couldnt hurt to at least consult a lawyer

Similar shit happened to me on Halloween.

I paid $60 for a ticket to see Caspa playing in a small venue here in Calgary. The bar oversold the show so the police and fire dept show up to kick everyone out. There were still tons of people in the bar when a bouncer comes up to me and starts pushing me towards a door. I'm struggling back telling him to fuck off kick someone else out. He pushed me outside into some cops. Then a COP who looked scared shitless starts pushing me around away from the door even though I'm already outside. I am yelling at him to fuck off, dont fucking touch me. Then he punches me twice in the face and throws me into a wall. Two other officrs help him throw me to the ground as im kicking and screaming. He then pushed my forehead into the ground with his knee cutting my face open really bad. I was bleeding all over as they drag me to their car. We drive to the station as they laugh about how someone was looking for a fight that night.

I've never been punched before this cop hit my twice. I've never been in a fight. I wasn't drunk at the time. I am now being charged with assault of an officer because he's saying that I pushed him before he hit my twice and smashed my face into the pavement. I've got a lawyer and he seems confident that the charges will be dropped. The cop was just really nervous and over reacted.

But I lost all respect I had for police. I never really thought about it much but after this incident I am seriously rethinking what the point of all that was. I am the one paying my tax money for these fucking pigs to roll around causing shit... fuck this system - something needs to change.

I have only ever had good experiences with them. Been pulled over for my subs being up too high (sound law in my town), guy walked up and asked what I was listening too. Told him Metallica, he let me go.

Got pulled over for speeding, showed him my license and registration and everything, told me to not be an idiot and speed as high as I was, and let me go on my way.


I guess it is just from personal experience because i have never had a problem with them

I'm sorry to heard that mang. Sounds like you got it much worse than me.

I have a friend with lawyers for parents and another friend who's dad is a correctional officer, so they both said they'd get their parents to help me out in this case. Unfortunately for the time being my parents have said they would not support me taking my tickets to court or charging the officer with anything.

Even though they openly said they do not support me, my mom went in and talked to the arresting officer today. Apparently the fact that I was near a party (I was a solid 4 blocks away) and with a group of people gave them a reason to search me. Which is complete bullshit. The officer also stated that the fact that I said he couldn't search me automatically gave police a right to search me. Again, bullshit.

thats such bullshit dude, it seems to be the same for every "i got caught with..." story Ive heard, if you dont consent to a search, the cops just flips it and makes you seem guilty, when your just using your right to deny a search without reasonable cause.

hopefully you take that fucker down.  also i believe if you cant afford a lawyer, as your rents dont seem to want to help ya, they will provide a free one.
