Drinking, but not being drunk while driving.

If you are 21 and older and under the limit for driving, and also drining a beer while driving, would that be considered a DUI or just a open container because you are under the limit?

Well its like a "level of retardation".

Like you have your average joe who goes out and has a couple brews, and a shot and gets behind the wheel with a .08 or .09 and can get pulled over and his life is wrecked because of it.

Then you have someone as special as my avatar go out and slam back a little of everything and drink your crew under the table. And then they decide to drive him with a .28
Circumstances are different, and I think if one was to be considered a felony, it should be the drunker person

Basically make .08-.10 a misdemeanor until maybe your 2nd or 3rd offense, but with obvious points and fines. Then have a .11 and higher for people who just are way sloshed and everyone including themselves should realize they should not have drove home.

Some states do have varying levels of punishment dependent on BAC. Their numbers are a little more realistic though. A .11 is by no means "way sloshed".

ahahahahahahaha how did i miss that....

but i do work with a guy who has a beer or two on the ride home but he gets bottles and if anything ever happened he keeps the caps right there to recap it and they most likely wouldnt notice.
