Hip Hop Q's: Breaks, Loops, Sampling, DJ vs. Producer

I have a few questions that deal with some things in hip hop that I've always wondered about.

1. Whats the difference between a break and a loop?

2. What is the legal deal with sampling?  Like is an artist allowed to take any part of any song and just use it in his.  Does he need a legal confirmation from the artist, producer, recording company?  Does he have to pay money to use it?  Does he have to pay royalties? 

3. What is the difference between a DJ and producer.  When a song is actually being created what does the producer do as compared with the DJ.

4.  When creating a hip hop beat do producers/DJs use live instruments like real drums, guitars, trumpets to make a beat or do they simply use electronic, pre-recorded instrument sounds or is it a mix?

DJ

A DJ plays and mixes music together. A DJ may use effects, looping, and other techniques to change the sound or structure of a track. However, they are not creating the music as they play in a club or festival.

Producer

A producer creates music in a studio using a DAW (Digital Audio Workstation). Such programs include Logic, Pro Tools, Cubase, and Live. They produce their own original works and also remix other producer’s tracks when they are provided with remix stems. Once a track is completed a producer sends it to a label to be sold commercially.

In response to #4, most hip-hop beats are composed of samples or pre recorded sounds, ie, symbols, hi-hats, kick, snare, ect. but some groups such as The Roots use actual instruments such as drums, guitars, trumpets, ect to compose their beats.

it does depend on the producer but here would be a good example of what pete rock and thus j dilla were working with, but as said above a live band is always dope as well
