Question of Morals?

Alright, so i made a post over the weekend about a kid who died in a car accident along with his friend, who was in the passenger seat. we knew this kid, and its really a terrible loss and a real bummer.

but heres the deal. My parents were talking today about how the kid we know, Jerry, his family will most likely be sued by the other family.

How on earth could you do that? i know it happens, but in a situation like this, how can you sue someone who just lost their child for money. Money that wont go to paying for treatment or something like that, unless it goes to charity it will most likely go right into their pockets.

First of all, what do they get sued for? negligence? how do they know that the passenger wasn't waving his hands in the drivers face? accidents happen.

Second, like i said before, both families lost their sons. How could you turn a terrible situation like that into a fight for money? what kind of asshole do you have to be? put yourself in their position, what if your son was driving? would you want to be sued? absolutely not...

Third, these guys were friends, they were buddies and the driver had no intention on causing the death of his friend. i also dont think that the passenger would want his parents to sue his friends parents.

whats kind of person do you have to be to do this? This is the problem i have with America, our legal system lets stupid shit like this happen. stupid cases where, under law, the driver is at fault, but under whats right and whats wrong in peoples hearts, there is no case here.

i saw a ski movie once, i wanna say some TGR movie or maybe matchstick. The guy said anyone who dues a ski mountain should be shot. people sue mountains when they fall because they suck and break a bone. under our legal system, yes, the mountain is at fault, but your just an asshole....

it's messed up man, but maybe that other family just feels like somehow they have to get some sort of vengeance for what happened. I think it's totally wrong, but maybe they feel like the driver's family hurt theirs because of what their son did (even though both families lost their sons) and so they feel like have to do something awful back to them.

I don't know, I think it's messed up and I agree with you. At a time like that I can't believe people would think about suing and money. It's horrible.

i mean i can see how you could be mad that your son died and someone else was driving, but how can you do that? what if it was your son driving? you could be the on getting sued. he could have been driving with 4 passengers in the car and killed all of them and you would be sued by 4 people. it almost seems like some sort of sick scam (like people that jam on the breaks so you rear end them), its just pathetic

Its a fucked up world we live in today. People don't care anymore about any moral standards, or moral duty. If I was his mother, I'd be hurt that this other family would be pointing the finger at me, its bad enough to lose a child, but to lose one then get hit with a lawsuit is horrible. I hope everything works out for your friend's family.

First off Jerry is a fucking idiot for street racing and hitting a tree. Obviously he wasnt very good since he hit a tree, and because as you had said before your brother called it that he was going to die in an accident. Now I know the friend was probably in the car under his own wishes but still Jerry was the one who risked his friends life. Now the worst possible situation went down and now the both families are out a son. I think that the friends parents have every right to sue Jerry. Now the suit isnt going to be against the parents. It will be against Jerry and Jerrys insurance will have to cover it. Sad thing is, alot of insurance companies have ways of getting around street racing shit. They dont insure people to drive their cars like idiots and its sort of viewed as the same thing as leaving your door to your house open and getting robbed. Insurance doesnt cover that. Street Racing is gay, your buddy paid a price and his parents and his friends parents are paying the ultimate price.

Unfortunately, this guy is dead on. But think about it, even though its fucked up, what kind of lawyers will the insurance company have compared to what the family can afford. Chances are unless they are loaded which i'm going to assume they aren't since they're doing this and the insurance company will just destroy them in court.
