Replying to Avoiding a DWI

Im not sure if this works but my cousin says one of his friends did it. If your over the legal limit and you get pulled over by a cop, you take the keys out of the ignition, get out of your car, close the door, and chug a beer right in front of the cop. that way if he gives you a breathalyzer(sp) test and you show that your over there's no way for the cop to prove that it wasnt from the beer that you just drank in front of him, and since you werent driving when you drank it its all good. right? maybe?
