Speeding ticket question

dont plead guilty. the most that can happen is you get what you woulda gotten if you did. the least, well it could go to nothing

yeah i know but since the ticket has my dads name on it can i take it to court or does he have to?

I assume the same goes for photos as it would if you got pulled over by the cop and he miswrote your name. That defense usually gets thrown out as the officer will affirm to the judge that you are the one he identifies as giving the ticket to.

If a photo has any identifiable elements in it that could be traced back to you, then they'll probably just identify you as the driver.. otherwise your dad will probably take the heat for it.

But for sure I always suggest taking it to court, as with alot of scenarios could end in your favor. However, in many situations it is possible for them to up the fine and increase penalty (such as you 'admitting guilt' / 'admitting fault to additional crimes without you even worrying about it.

I really wouldn't reccomend mentioning that you were following a car and he was 'speeding', as that's not gonna make any difference to the judge.

There are traffic lawyers you can pay some money to that'll fight your case for ya. That would be my best reccomendation. There are also some companies that'll help you out with all your legal stuff when you keep a lawyer on a cheap retainer (like $40 a month.. yeah, you get what you pay for. but any lawyer is going to be better than none)

so you think that if i went in taking the blame for being the driver they wouldn't say anything about it having to be my dad?

why do kids these days have some much trouble taking responsibility for their actions. Don't try and rub it off on your dad. Even if he gets hit with the legal part, he can hit you with a ton more then the Law ever could. Going to court and trying to get it lowered or taken away is fine. It is how out court system is supposed to operate. I don't know how old you are, but if I was a judge and some kid came up and was responsible about what he did I would be likely to give him a probation period instead of the ticket. Chances are he sees dozens of dumb teens every day who try and weasel out of their tickets/MIPs/possessions/whatever. Saying you knew you did it with and honest apology can do wonders in our world. Not many people expect apologies from people these days. If you give an honest apology the fine won't be raised. And worst case scenario is that you get a ticket for something you did. There are a lot of worst things that could happen, like getting a girl pregnant.

Truthfully, if it's just a fine and not going to add any points on your record. just pay it off. If it's a fine, but you or your dad qualify for traffic school then just go that route.
