this is so dumb, this reminds me of the 1st grader who go expelled for sexual assault. hahahaha. how can that happen. 3rd graders can't ski recklessly.
This story makes me sad. I am sure this guy will lose, but the fact that it even entered his mind to sue a little boy for this type of thing is dispicable. He put himself in harms way just like we all do as soon as he put on his boots.
David J. Pfahler of Allentown, Pa., filed
suit in Denver federal court claiming Scott Swimm of Vail, then 7, was
skiing fast and recklessly when they ran into each other in January.
Pfahler's suit says he suffered a torn shoulder tendon.
needless to say this man is a jew in every sense of the word.
Just read it in the paper today, CRAZY who would ever thing about doing something like that. Accidents happen all the time, but there accidents, it's not like the kid threw a "ice ball" at the guy or anything, he accidently ran into him, shit like that happens all the time, it's just a sham the older guy got hurt, but there's no reason for him to be a dick.

Arent these the kind of lawsuits you here about in california? like this one is more rediculous then the the guy that tried to sue the California Cheese company, because in the commercial it says "happy cows come from california" and the guy was claiming that the cows in california arent happy.

Completely absurd. As much as it drives me wild when 8 year olds point it and straightline out of control from the top, I'm not going to take it out on some little kid because I have osteoporosis and my bones are so brittle that a 45lb kid hitting me is going to bust me up.
If some little kid hit me, I'd feel bad for the kid because he'd be WRECKED.
This is a good representation of another reason for my screen name. Lawsuit happy gapers make up a good percentage of the skiing population here in Pennsylvania(east). I'm not surprised that some gaper 60 year old from Allentown would try to take an 8 year old to court for hurting him. This is the reason we here in PA are kicked out of in-bounds trees at most resorts.
Bottom line is the guys a turd, my state(at least eastern) is full of em and this doesn't surprise me at all. I'm 20 minutes south of allentown and should flaming turd bag this guys porch on principle. The lawyer looks like a leech on the ski industry to me.
Don't blame the lawyers, blame the law. If you're a lawyer and this sort of thing puts food on your table you're stupid not to take advantage of this ridiculous situation. The LAW should be changed to prevent such massive payouts from frivilous lawsuits. Here in Australia we've put a cap on the amount of compensation that can be received for certain injuries. It's not perfect, but it helps avoid situations where someone's awarded $10mil for a burnt tongue from a hot coffee.
