they arent the police, they cant do shit, if they try to search you just start trying to search them because you have just as much right to search them as they do to search you
patroller: we are going to need to search yo
you: no, why?
patroller: we just need to
you: can you please take your jacket off, im going to have to inspect it
patroller: wait what?
you: yeah take it off, i need to search it
patroller: you cant do that
you: neither can you
end of discussion

not 100% true. you technically are on the mountains property... so you have to follow the mountains rules... so the power that the patrolers have to search you is if you refuse... then they can just take your pass and theres nothing you do. But if they do find something illegal... its probably not admissible in court because it the search wasnt legit.

well put.. when ski areas lease from the forest service the forest service gives the ski area power to set up rules on their land

Patrol cannot search you without a valid reason.
Depending on the resort, location, how its owned etc..
If they have a reason.. they can ask to see the contents in a bag if they feel it has the potential to put other guests safety at risk.
IE. They saw you drinking, and saw a bottle get placed back in the bag, they can ask to search and if you refuse escourt you off the mountain and contact the police.
Its because if you hurt yourself or others and it goes to court and you say "Well yes I was drinking, but the patrol saw me and did nothing. Thats why I ran into some guy." the judge will say "Well the fault is at the resorts level as they failed to attempt to remove the guest from the property."
Same thing goes if they see you with drugs.
Don't quote me on any of this, I'm just going on what I know from the resort I work at haha.

Not sure on if they can search you. but on another note...I got my pass clipped for hopping a rope, and when he punched the hole, he did it right by my lip and it looked like I had a joint in my mouth.

has anyone who actually answered this question looked at the rules of consent you agree to when you purchase a pass? Or is everyone just an "expert" based on their own standards. I'd think they probably have a clause that gives them more power than you'd think.

Isnt it that if you sign the waiver it doesnt really count in court coz you gotta sign it to get ur pass so its blackmail

they are NOT aloud to search you. Unless you have a weapon. but still they would have to call the po po bc they are just civilians still.

haha, thats funny...but people on this website are actually pretty knowledgeable, half of the time it is because we are always looking up shit on the computer and doing legit research.
it makes me laugh how many kids are actually smarter then people that work at resorts and ski shops.

How the hell is that black mail? No one is forcing you to buy a pass or go skiing.

Hahahahahahhahah
are you kidding me? every pass says that if you get your shit wrecked on the mountain you aren't allowed to sue. That didn't stop that assfuck in washington. So first point, the back of the pass doesn't mean anything.
secondly, I'm no expert on resort procedures, but I do know a little about how our country works... there's this part of the constitution that protects you from illegal search and seizure.... and that has to do with government law enforcement. There is no way that a person who is privately employed (ie has e less power than government officers) can LEGALLY search you without your consent. However, if you don't give consent they can ask you to leave.

they can make you leave the premisis, and i'm pretty sure you sign a waiver saying they can revoke your pass at anytime.

i always wanted to know what would happen if ski patrol busted into a 617 blunt session in the woods, if they'd search my camera bag or my pockets.. but it'd never happen because i'd peace so quick.. straight bombin' switch

Dude, ski patrol can't search you. There for saftey! They help people and enforce only the skiers code. They have to go through medical courses, not the police academy. Come on, that's just common sense. They can hold you and call the police and they can search you, that's as far as they can go.
I had me SETH's stoled last year from Keystone. My friend and I looked all around. We went into the gondola house to tell the lifties to look out for the skis. Then BOOM, the two kids that took my skis were in the lift line to down load to the bottom. The only thing that the ski patrol cound do was take them to the bottom and call the police, they could do nothing more. Even though they smelled like weed and everything else they had to tell the police to search them.

You should mention that to them when you are lying in the snow needing medical attention, oxygen, and transport off the hill.
They are there to save your ass, not to search you. You know how many people would die painful freezing shitty deaths on ski hills if it wasn't for ski patrollers?
Think of them as paramedics, not police.

i know that but they are lower in terms of law type authority than mall security. they still do some awesome stuff and save peoples lives.

Ok, look at it this way.
Ski Patrol =paramedic on snow. BUT...they can pull there pass also.
Kinda like a mall security and a paramedic combined onto the snow!
They are there to help you not hassle you!

OK, I see what yer sayin, and you are correct..
It just seemed like a "let's hate on patrollers" kind of thread, and those burn me out because in general they are the good guys..
Peace

Yea, they are good guys.
They help me look for the kids that stole my seths for about three hours and never gave up unitil we founf the kids STILL on the mountain!!
They really are good people, they just have to put up with a lot of crap.
I use to make snow at Keystone, they are pretty cool guys!

At my work (I work at a sporting goods store) some ni66as were stealing hats and all my co-workers and I could do was stand there and watch them. Maine state law says we cant do shit except call the security guards who cant do anything unless they're in our store. Obviously the kids left when we called so they were home free. fuckers.

Maybe it's an American thing that I don't get but.... why in hell would a ski patroller even bother searching someones bag or clothes? That's like a fireman trying to search you...
For alcohol? alcohol is sold everywhere on the mountain.
For weed? then they'd have to take more than half of the people off the mountain!

didnt read this thread but hope your kidding from the title. The only other people who can touch or search you are the police + government and they need a fucking good legal reason for that too. The one time a ski po tried to cut my pass with her special tool for jibbing a shack roof i slapped it right out of her hand, told her to get some shorter poles and skied off
most people just bow to any type of authority that seems sligtly intimidating or threatening and give up all their rights

k so i knew they couldn't search you themselves. and i was just making sure that they can ask you to leave since it is private land (most of the time). but the real reason for this thread was to provoke a nice discussion of rights. and for people who don't know they can deny a search, you can.
this thread is a classroom in disguise. the kind of classroom that teaches stuff we want to learn.
