BC Court finds school partly to blame

3 million dollars awarded (from the school) to snowboarder who paralized himself in the Blackcomb Terrain park 3 years ago. Whistler/Blackcomb also settled with the snowboarder outside of court.

WHAT WILL HAPPEN TO TERRAIN PARKS NOW???? If he got 3 mil from the school...just think of what he got from the mountain. Terrain parks don't bring in all that much money to any resort....well not enough to cover even 1 lawsuit, let alone the insurance hikes that will come of this.

yeah a lot of that shit has happend here in wisconsin and quite a few of the hills around here have taken there rails out of the park because of insurence and lawsuits. i think that the hill should cover there asses by haveing people sign a release form or some sort of sign at the enturence that relieves them of reliablity

thats a good idea, but im sure it costs money to implement and enforce things like that. Blue mt. In ontario has something like that. You have to have a weiver signed by someone over 18, watch a safety orientation video and a bunch of stuff to earn a park pass. The park is fenced off to everyone except people who have got a parkpass. Its great. And if anyone hurts themselves, the mtn has all of that to back them up.

If you guys ever read the back of your passes or day tickets you will see that they are releases of liability. usally they say stuff like 'convents not to sue this corperation, ect. ect' but when you get in a court case like the one with this kid, a good lawer can argue that right out the window. what I am trying to say is that even if they had you sign a relase, a good lawer will not care, cuase they can get what they want through some strange loop hole.

i heard at whistler you ahve to sign a waiver or somethign just for the park. so by purchasing a lift ticket and signing the waiver, how can he sue? i guess good lawyers can get through that, but i dont think they should. that just means that the waiver doesnt mean anything. i dont se why the kid wants to fuck over our sport becaus eof his own mistake. that is so rediculous

yeah in the non paying park there were no straight tables because public liability insurance companies have said its too easy to hurt your self on them and if they had them the premium was bumped up heaps. thats why they had 4 really gay hips because no punters go big off them.

The school didn't just give him 3 mil, they HAD to because the BC court system found them to be partly responsibly, along with Whistler-Blackcomb and the rider himself. Whistler-Blackcomb did not go to court, however they settled out of court. (This also coming from a reliable source)

Unfortunately this now sets the precedent for future cases that may be similar to this. This will probably not be the last we hear of people suing resorts over terrain parks.

He could sue because he was injured before the new park system. He was injured in 2000 or 2001 before the new park system with manditory helmits and a pass was established. I dont think parks should have a problem after this as long as people sighn waivers to ski the park.

I heard that waivers don't hold up in court if the mountain was really neglegent. But that kid is a stupid shit that shouldn't ever be able to touch a lift ever again.

the dude settled with blackcomb 10 days before out of court soo he will not be getting the 2.9 million it is w/e blackcomb settled with out of court and they did not say how much that is. and the school district will have to pay him 500,000$.

alright though you guys are not the ones that got paralyzed...and he was not succesfull in sueing the mountain but yeah he did get money from the school which is going to help his poor parents pay for the hospital bill he is not just going to have 3 mill to blow on whatever he wants....it kinda makes me sick to hear people call some paralyzed dude a selfish asshole...the park won't change next season becuase nothing happened with the mountain...so yeah alright i have said enough.

blackcomb did get charged the where blammed 70% and school was 15% and the kid was 15%. divide that by the 2.9 million that was awarded to him. but the jury did not know that blackcomb settled with him out of court 10 days before the trial for a undisclossed amount sooo yess blackcomb did get charged.

it makes me sick that people put the blame on other people for there own mictakes, its too bad that people cant use there brains or good judgment, r atleast even take responsibility, at all the resorts you see all these stupid signs they have to put up just to cover themselves even though it should be common sense, yet people still find a way to blame other people. grrr crap like this makes me so angry and its immpossible to change the close minded peoples views on stuff like this when it should be obvious who is right and who is wrong. so frustrating...

the mountains will loose alot off money from this decision because school ski trips will be no more. and whistler-blackomb that is a huge business for them or any other mountain for instance schools are not going to goo on ski trips with the chance that they will get charged.

sueing for medical bills is one thing, but doing it cause u think your entitled it because of your own mistakes is just retarded, i mean maybe suing the school is ok, because he was there responsibility, but whistler is no way responsible, did they force him off that jump? no. is there a warning at the top of the park and lift ticket? yes. he deserves no money from whistler what so ever!

There is this thing called DISABILITY INSURANCE (kinda like welfare) that people can get if they are unable to provide for themselves due to injury. It definitely sucks that this guy is paralized...I mean any one of us would be destroyed if it happened to us. But at the same time, every single person in this world needs to take responsibility for his/her own actions. This includes the snowboarder, who may or may not have been going beyond his limits. Was he going too fast? Was he trying a new trick?? We don't know. Whistler-Blackcomb also has to be responsible for their actions....did something happen that made the resort negligent in some form???? I guess there was something there that made the court decide that 70% of the blame was the mountains. This, unfortunately, goes way beyond libility waivers, signage...etc. Terrain parks are MAN MADE objects. If those MAN MADE objects weren't there in the first place, accidents such as this wouldn't happen. This is what we have to keep in mind. I don't think anyone who 'properly' uses terrain parks would even consider suing the resort over an injury. But hey, how many of us have actually sustained a life altering injury?

If I did something stupid and paralyzed myself and I could get 3 million dollars I would do it in a second. I wouldn't care if there werent terrain parks to ski in. I wouldnt be able to ski anyway. I also wouldnt care if a bunch of people on the internet were mad at me. But since I'm not in his shoes hes a bitch that shouldnt have sued for all of that money since he made the mistake.

but i still think its bullshit this guy suied the mountain. he signs a wavier form with his school too. This is more serious for whistler blackcomb and many other mountains then people realize i think all the school trips will be cancelled and that is huggggggeee business for the local hills here in the lower mainland. and it could also affect all hills in canada.
why on earth will schools wanan take the risk of getting suied when they make these field trips.

alright i read the release and i guess he wasnt trying to sue whistler, just his school. I feel really sorry for him, and i cant imagine how awful it would be to be paralyzed. and i realize he may need medical money, but i dont think beyond that anything else is really exceptable, it was 100% his choice to go off the jump, so in the end it was his own fault, not the schools, not the mountains. I guess the real blame should be placed on the courts who allow, and by allowing, encourage, lawsuits like these, and also for our case put whistler 70% at fault for something that wasnt theirs.

since whistler was not sued there was no precedent set!!!!!! whatever happenedout of court in no way gives any sort of precedent. and the kid suing is doing what he has to is it shitty yes, was he truely the only one at fault yes, but its just what he has to do.
