I think it's crap. Maybe that's just because I'm looking into becoming a doctor, but I think it is ridiculous to sue a doctor for an accident or mistake he makes. I guess it depends on just how negligent he or she was, but for the most part, the doctor is doing the best he can, and you cannot exepect him to be perfect. Any thoughts?
If there is big enough of a moron out there to sue someone for trying to help them out/save them in a way.

I've heard this stories like incidents where someomne would give someone else CPR and they sued the person for saving there god damn life, all because they tore their shirt or broke a few ribs or something stupid like that.
It depends on the situation. If it's just a simple mistake, the patient has written off their lives (so to speak). It's why we have waivers and insurance and all that fun stuff. But if the doctor was drinking or took something to impair himself/herself mentally or physically, then it's pretty clear that the patient can sue.
^yes that's understandable. if the doctor is being grossly negligent and terribly careless then by any means, sue his ass, he shouldn't be even be a doctor.
although I can see both sides of the arguements view.
because my dog had to go in for surgery on her leg. she fucked up some stuff in her knee real bad. Anyways the doctor cut off like an inch skin all the way around the wound. way more than he needed to... noone knows why he cut away the skin anywyas? He could have just sewed it up. My dog had this like vicious open wound on her leg that was the size of my palm I guess. It had like nasty staples and stitches and tubes coming out of it from all different directions, basically everytime she moved that leg it would tear a little and started bleeding again. It was like some kind of crazy science project gone wrong.
My dog almost died, but then after like 2 months she pulled threw it. It has been a number of years since though and shes perfectly healthy and normal now.
I am really greatful for that.
but it just kinda really pissed me off at the time seeing my dog in so much pain.

actually thats the one thing that cant happen. Theres a law called the good samertians law that states that if you are in a state of medical need and someone admnisters help such as cpr with or with out your consent (if you were passed out) and does something like cracks a rib or tears your shiry you can not sue them or take any legal action against the person the admistered first aid.
The guy who stole your walet while you were passed out on the other hand is fair game
i think the good samaritain law only applies in Canada, and i believe if you take any gift or payment from the person, ie he buys you a beer for giving him the heimlich or something, it voids your protection as you are considered paid for your services or some shit. Malpractice is bullshit, and how quick people are to sue over stupid things in the states is one of the things that disturbs me about the country. Shows some maturity and suck it up bitches!,
i think it's alright to a certain extent, but with the amount you pay for surgery, i don't want some idiot doctoring forgetting that he left some stuff in me, like scalpels, his lunch, and shit like that
what if the doctor came to fix up your ACL on your left knee and instead did the opperation on your right, I've heard of that one happening before, and i think i'd be pretty pissed off if the doctor fucked something like that up. I guess it depends on the error, if it was something that went wrong because of natural risk, than fine, but if it was more on the lines of neglect or something preventable, than yes the doctors ass should be on the line.
i also think that if a builder built you a house and through neglect or some sort of preventable error, causes your house to fall down you'd sue him. Same deal right?
fair enough then he owes you a house, but who justifies pain and suffering, i mean do you really deserve millions of dollars because you were out of a house for a while, that seems a tidge greedy the way people demand so much for their inconvienence.
yep. it sure is retarted for sueing a doctor who, while operating on your daughter, made a huge mistake, which in turn cost the daughter her life. (YES this REALLY happend to my friend's family).
well for the most part i agree with most of the things that were said. However when a mistake is made that may impair that person for the rest of their lives, i believe they are entitled to a settlement even if it was a mistake. or in the case of someone else i know that went in for gastric bypass surgery. the doctor aparently nicked her bowel and didnt take care to notice it until she was practically dead from the infection spreading throughout her body. what was supposed to be an overnight procedure turned into a month in the hospital in a coma and then having to learn to walk and all that stuff again. whats funny is she gets stuck with all these medical bills then have to sue to get them paid for which will most likely take years to be finalized.
i thought about it some more, and if the doctor made a true mistake, and was very careful and tried hard but still made a mistake, then i bet he'll already get punishment within himself. if i were a doctor, and a patient of mine died because of a mistake i made, i'd be so traumatized and depressed, and i think that's enough of a punishment.
my mom had tooth implant surgery and somehow the guy damaged some nerves and as a result lost her sense of smell. She tried to sue but the lawyer said she couldn't win so he didn't even try, so now she can't smell fire or even a skunk. That's just fucked.
My dad broke his hip in 1996 and the doctor that was suppossed to fix it fucked the job up hardcore, his left leg was a full 2 1/2 inches shorter than his right and he had to wear a speical shoe that looked like some old disco platform style thing so that he could even walk... my dad has many friends that are doctors and they examined my dads break in his hip and explained that it was such a routine surgey/opperation but nevertheless the doctor repaired it incorrectly and between 1996 and 2000 he had 4 corrective surgeries and the case finally went to court in late 2000.. my dad was sueing for pain and suffering and the hospital bills that we had to pay for the total of 5 surgeries. (1 original and 4 re-corrective) the guy got off scott free and since then my dad has had 3 more surgeries.. yea i think doctors should be sewed if they fuck up.. doctors are suppossed to be flawless, and if they can't take the pressure, they shouldn't be doctors.
