i saw this on the news and couldn't believe that they were actually trying to get this guy on manslaughter. read the article, its freaky that this could happen to any one of us. Also do you guys remember about a year ago and 18 year old skiier hit and killed someone, he got 90 days in jail and 3 year prohbation. This is messed up

what article are you talking about?
BACON (receiving a monstrous, leafy cocktail)
What's that?
SAMOAN JO
A cocktail, you asked for a cocktail.
BACON
No, I asked you to give me a refreshing drink. I wasn't expecting a
fucking rainforest; you could fall in love with an orang-atang in that.

its like the lift operator from Vail I think it was, his ski came off and slid down the slope. Hit a lit bump and nail some guy in the temple and it killed the guy. He was chargfed with manslaughter

that would be the same as hitting someone with your car and hitting them

no its nothing like hitting someone with a car, cause he couldnt control the ski once it fell off...if anything is to blame its the bindings (or his DIN settings)
Sahid: I know how it is

didn't read the article so I might just be talkin out my ass...but you have to have your equipment working with proper brakes. and since he didn't do this he neglected to follow the code making him criminally responsible for the death. If you are driving your car and a guy walks down the sidewalk and then decides to jump in front of your car and he dies, you will still be charged with manslaughter...you can argue its different but in my opinion it's not.

in response to reedy, i can see where your coming from with the ski equiptment not being properly set and what not, and in that case the guy would be fully responsible, but your example of the car is a little off, because if the person jumped off the side walk and it wasnt a cross walk that pedestrian would be at fault and if they lived you could acttully sue them for any damage they may have caused you or your car. if they died im sure im not sure what would happen cause you cant sue a dead person but the pedestrain would still be at fault.
I just wanna ski, is that to much to ask in life

From what I understand, both skiers collided and one of them got sent into a tree and died, thus making the other one 'responsible.' It's all bullshit, becuase when you buy a lift ticket you automatically recognize the dangers of skiing. People that try to sue or prosecute someone for an incident like this just don't have their heads on straight.

no it was a liftie from keystone. he had alcohol and drugs in his system. he hauled balls down the hill and when his trail merged with another they collided, he caught up to the other dude and killed him. It is manslaughter, enough said.

and when i say caught up, i mean that is how they collided, i don't want to imply that he chased the dude down.

thats the whole deal about manslaughter. You don't MEAN to kill someone, but someone dies due to your neglegance or carelessness.

it doesn't matter if it was his fault or not. since it was his fault that his brakes weren't working properly, he is negligent and because of that, it was a direct cause of the guy dying.
we just did this kinda cause and effect stuff in my law lecture today

god damnit, the dude that got charged for manslaughter and got 90 days in jail and 3 years of probabtion was a liftie from vail, he was coming down at the end of the day going really fast and he went of a roll and nail this dude, the guy he hit died a few minutes after. The liftie had alcohol and weed in his system and also was in possesion of weed.
