We're talking civil law, not criminal. Has nothing to do with getting a fine or charged of murder, it has to do with being sued.

For example: you have a party, I have a couple too many drinks then drive home and kill Mrs. X. Mrs X's estate (family) could sue you for her death. Basically, they're saying it's your fault that Mrs. X died, so you should pay.

That's a tough one. I think you'd have to take into account the size of a party. It would prove a difficult job keeping track of who had how many drinks, and who left when. I've been at parties where the host has everyone's keys, but the people who drive drunk always have a backup, especially in a magnetic box under the car. So are bars going to be held responsible in civil court for accidents too? So now the victim's families are going to sue the family of the drunk, and on top of that get money from the host of the party, what about the company that supplied the keg?

their trying to pass a law to make concert promoter liable for drug use at concert festivals. so basically the promoter can get sued if someone ODs at a concert, or police can press charges against them if theirs drug use at festivals. i think its bullshit.

that would be bull shit if you had to pay for another persons drunk actions. i mean yea the host had the party, but it's not like the host could have done anything to prevent the acciendent, the host was probably smashed too and the drunk was like 'well im outa here'........of course you're not gonna tweek, 'YOU CAN'T LEAVE, YOU'VE BEEEN DRINKING!'.......you jsut get laughed at, and probably laugh at yourself. good call by the court systems. weird to say that one, normally it's always such a shitty judgement.

gravtek: The keg thing is exactly it! How far will they go? Bartenders can be held liable if they let someone get completely smashed (that's my understanding anyways)... they are not supposed to server drunk people. I think..

Darryl: my memory is terrible, but either they haven't reached a decision yet, or the company was held 10% responsible.. I know the lawsuit wasn't completely succesful.. I'm pretty sure they haven't reach a decision yet.

the guy who throws the party may not be criminally liable but then again he may be liable in the civil trial, those are the trials where the stupid shit hits the fan. Trials such as the fat guy suiing the fast food restaurants claiming that the shit is addictive. He lost i think, but then again there was the lady who sued mcdonalds for the coffee not having a warning on it, winning millions in damages. In this country it is way too easy to place the blame on someone else for your actions and turn that into a lawsuit. Frivolous lawsuits have affected out skiing lives as well. There are many boundary rules, areas are closed off and marked so that the resort isn't held liable. In Europe where people hardly ever sue for something that is their own fault you can ski wherever the hell you want, and if you get in trouble, well, that's your responsibility. Which to me is appropriate, because yes, if you go after the person who threw the party you could then go after the liquor store, the distribution company and the beer manufacturer. In conclusion...it is way too easy to sue in this country.

I think that sets an awesome precident! It's YOUR decision if you want to get drunk, and YOU are responsible for your own actions. At least you should be. Furthermore, if you're dumb enough to get in a car with a drunk driver, and something happens, there's no way you should hold the person who owns the place where this idiot got drunk responsible! Maybe this is the beginning of a turnaround in the judicial system! I hope it catches on to certain ski related lawsuits!

I think it's a good decision. Some may say that because of this ruling, the hosts of parties won't be that concerened as to how ppl return home and if they get home. I don't think this call will change too many ppls way of thinking. So in all it's a good decision. Make people responsible for their own stupid actions.

But about the McDonalds thing where the lady spilt coffee. I'm on her side. We looked at this case in law last year, she had to get skin grafts because of the severity in her burns. If that happened to me I think I would want to sue aswell. But looking at our society, if something goes wrong we tend to look for someone to blame it on. Like the guy saying that McDonalds is addictive and made him fat. So in all I think that decision was a good one by the courts.
