Music in edits without copyright infringements.. how?

so I just made my first edit, but i can't upload it because the song in it causes copyright infringements..

how to i get around this so i can use the song?

i googled but all the answers i found go way into legal details and i just want to know how you guys do it so i can too

Upload it to Vimeo. Youtube uses a software program that listens to the music in your videos and automatically flags copywritten material, on vimeo, someone has to actually report it, which never happens.

What song are you using?

Ive uploaded songs to youtube with pretty popular songs...


technically, if you're not making money off of it there is nothing to sue over but if youre just making an edit with your friends dont worry about it. Youtube just has this shit in place because mad people upload songs of artists so others can listen without buying and record companies don't want that to happen. This in turn fucks over people who just wanna use a cool song for an edit with their friends.


Like people have said, fuck youtube, use NS or vimeo, or both!

In the past I've made negligible changes to the song to sneak it past the copyright filter. I haven't done it recently so I don't know if it still works, but I used to change the speed of the song just a little, change the pitch a little, and run it through an effect of some sort (very slight wah wah or something similar). Normally, you could barely tell a difference between the new version and the old.

We're talking about putting a song to a ski video and putting it on youtube, not setting up a program that allows millions of people to download millions of songs for free.

If you put something on youtube, millions of people can download it for free. The law is stupid and usually not enforced, but it's still technically there. Just because you don't make money off something doesn't automatically mean you get permission to use copy written material. Although it may help you qualify for fair use, it doesn't guarantee it.

If it's on vimeo, just post the link to FB. It should automatically embed the vimeo player in people's news feeds.

Weather or not my logic is "flaw" is an irrelevancy, since we can just look at the relevant law. You MAY qualify for fair use when you use a song in a video you make, but you also might not, and the fact that you are not intending to make money off of this video is not the sole deciding factor. In fact, there is no single objective deciding factor as to what constitutes fair use and what is infringement, which means that you can get sued and may have to argue your case to a judge. If you post an edit on youtube that gets a lot of views (say the hundreds of thousands), then it could be argued by the copyright holder that your action is depriving them of revenue, even if you're not making money off it. Also, since Youtube has adds on their website, they ARE making money off of it, which is why they have a policy of removing copy written material when they become aware of it. If they didn't do this, they would be sued (and have been).

And you missed what I even said. You said people would download his video for the song it was in. Maybe 10 people have EVER downloaded a ski video for the song, its not like the other videos with the album art that just play the song, thats what companies are after.

search through myspace and you will find a fucking bazillion artists which will be pretty happy to provide their music for any video that will generate 1000 views or so.

i did it for a 26 minute vid. i got a french rap track, a good friend of mine with a piano instrumental, an ACDC cover, a reggae/rap freestyle and some philter tracks for free.

best part about it is that youre creatively looking for unique stuff. not using the same old gangsta shit/electro shit like everybody else.

use classical music, do something noone has done so far. ORIGINALITY GUYS.

The companies go after whatever they think is worth going after. I got a video flagged by WMG once because a song was playing in the background under my narration. There's nothing in the law that explicitly gives permission to people using songs for personal video projects, unless it is for "educational purposes" or criticism, which you MAY be able to argue your edit into, but it's not cut and dry. It is certainly wrong to say that just because you are not making money you suddenly have permission to use whatever copy written material you want. That's simply false, but, if you stay under the radar, it probably doesn't matter.

And definitely like feihlination said, use classical public domain music a.k.a most classical composers who have died over a 70-100 years ago (at least according to general EU copyright laws).

easy. no need for calling names. i am pretty sure that under ANY law there is a certain time limit when songs become public domain.

with a little "rational thought", you would know that the music itself, the song becomes free. as mike-o said, i am sorry that EMI thinks youre not worthy of listening to this masterpiece. but thats because THAT EXACT VERSION's orchestra has the rights on THAT EXACT VERSION. NOTHING MORE. look on myspace, you will probably find 10 artists playing that track who would give it to you for free legally.

To be fair, making a post about how most classical music is public domain and including an embedded video that is blocked due to copyright infringement, is pretty damn funny.

My advice to the OP is still to use whatever song you feel like using and post it to vimeo where you are less likely to be flagged. There are some places where you can get music that you can legally use for free, but if you're small time, I just plain wouldn't worry.
