OKay, so some sex lady came into our school the other day to teach us about safe sex or w/e right? Well what she tells our class is that if there is any drunk person involved in sexual activity then it's rape. If the guy is drunk it's rape if you has sex with a sober chick, if the chick is drunk it's rape if the guy's sober, and if both are drunk then it's still considered rape (supposedly)... I had never heard this before, and I was just wondering if it was true or what...

if your both drunk there is no charge, as long as its proved, but there probably is a lean going against the guy(as far as i know). if your both drunk and its underaged then its not rape at all. it turns into a misdemeanor and i think your parents get the shit.

^^um, it's not statutory rape unless on the people is an adult. if they're both 16, then it's just sexual contact by a minor, or something like that, and it has a way lower penalty, and almost never will actually be charged on someone

according to VT state law you cannot give consent (no matter what your age is) under any substance. and if you are under 16. So even if you are 21 and are drunk and have sex with some dude you can nail him with rape charges.

exactly, no one can give consent when they are drunk, including men. If a woman has sex with a drunken man, he can sue her for rape. and if she had been drinking too she can counter sue him and chance are her case would go over much better because she's a woman.

I think statutory rape is the worst law ever. If both people agreed to it, weren't drunk, and neither had a problem, whos business is it to intervene? Lets say the guy was 18 (I believe its 18?) and the girl was 17. Ok thats statutory rape by the books. What if the girl is 21 and the guy is some 45 year old piece of shit? until you are of age you do not have the mental capacity to consent to sex.
