Am I Liable?

If I were to build rails/boxes and sell them locally and a buyer got hurt on one, could I be sued? If so, are there ways to avoid this such as a liability waver or something? Thanks.

yeah im pretty sure if you just make them sign a waiver youll be fine. i dont think youd have this problem in canada

if you make a waver that states you are not liable for any injuries that happened on your shit and make them sign it you should be good

To make a legal waiver he would have to make it into a legit company.... overwise you are not covered.

So would there be any way to cover myself with a small, not legit company? non legit as in im not paying taxes or anything to the gov't.

Try only sell to people that wont sell you out....

But as far as the law is concerned.... To have a waiver you have to be a legit company otherwise any documentation is not valid.

Just type up a piece of paper that says something along the lines of:

"I, _________, hereby swear that I will take no legal action against [your name] with regards to [said product]. Skiing or snowboarding on rails and boxes is dangerous, and I am aware that I am subject to injury, both from my own stupidity, and from the possibility of product failure, and regardless I am completely responsible for any and all bodily, property, and all other damages that may occur.

Signed: ______________________"


Done. If it has his signature on it, it is a legally binding document. It can be written on Kleenex, or even on the rail itself. (not recommended). If he signed, it is valid in court.

At least, such is my understanding. Lawyers of NS, feel free to refute me. (LOL, NS doesn't have lawyers!)
