Hey guys! 

Ok, so I know that some of you have been prank calling this Kevin Smith show lately.   I know he went and pulled a stunt like posting your numbers on air, and that was total bullshit.  

Now, everone is talking legal action, and personally I reeeeeeealy hate dealing with lawyers no matter who is right and who is wrong.   So what would be awesome is if you gys could just cut it off and let the prank go.    I know you're probably still angry about what has happened, but damage has been done and people are getting angry. 

Whether you think that we can be brought into this or not, the truth is that when lawyers want to be a pain in the ass, they can do it.   No matter what is right or wrong.   NS is a great ski site, and lets keep it to talking about skiing, no? 

So if you could, please, for me... even if just so that I can keep working on making this site better instead of dealing with this...

Stop pranking the Kevin Smith Show.

He's not really talking about legal action, he was just trying to scare kids away. Seriously he's admitted 100 times that the only repercussion is that a prank callers number will be posted on the air...he even says 'prank callers if you want to call in, that is fine, but you are risking your number going on the air for my viewers to see"

For all you guys asking, he did a live show that was basically about aliens and stuff, it was pretty dam funny. We would prank call him and mess with him.

I think if anyone would to be get sued, its him for posting information that we did not want him posting

but anyway, sorry Doug, didnt mean to get the site in trouble. It was fun while it lasted

Here is what Kevin Smith posted on his Myspace page regarding the prank calls:

Idiots

I have gotten a number of e-mails lately complaining about the little group of idiots who are harrassing the show with their telephones. Believe me, I would stop them immediately if I could. But, it isn't possible to do instantly.
What these guys do nto realize is that by putting this plan together on a web site (forums), it consitutes conspiracy. The fact that it was done via the internet makes it a Homeland Security issue. They and the web site owner are all in the pot together as conspirators.

Following the show tonight, I made a phone call and got the ball rolling on a criminal investigation. I also forwarded their telephone numbers, names, and addresses to my attorney for civil action--eventually.

Other measures were taken that I will not reveal here, but are measure they will definitely find not pleasurable. The show went through a severe attack two years ago. Some of you may remember. It was irritating and frustrating, but in the end, I won. I am still here, and the person who was behind it found it necessary to go out of business.

In this case, the conspirators are spread out across the country and using the internet to carry out their conspiracy. What they do not know, I am certain, is that one of their number has already confessed and gave up names, including the information that this conspiracy was hatched on a particular web forum--he named the forum.

So, this case is all but closed. We will have to live with the drivel for a while longer as some of these idiots will choose to not believe we have them until the federal marshals knock on their doors. Tracking down people who do not wish to be found is what I do well. It has been done, and the wheels are turning against them right at this moment.

This was spawned as a result of someone posting a link to my site in the forum. These morons thought it would be fun to clutter the show. Of course, when they call the 800 number, it costs me money. Furthermore, their harrassment calls block you from being able to call in. They flood the 800 number with calls and that keeps out legitimate callers.

Oh, well. I warned them on the show that if they wanted to play hardball, welcome to my league. Did I not? We shall see what we shall see. I've never lost a case, and I am confident I will win this one.

Sorry for the aggravation it all causes you, as legitmate listeners and callers. We will have it cleared up as soon as possible.

First off, learn to block out your numbers, the conspiracy charges cant be linked to you through your NS acct, but they can affect doug, and considering I dont think NS has a user license agreement when you sign up that could cause some shit. Does he even have any recordings of you calling in or something? I didnt take part in this but if he doesnt actually have any evidence that you were prank calling beyond that you called in that really doesnt get him anywhere. Overall, I say hes bluffing, bet he cant do shit~

lots of "I was skiing in Utah last summer, and i saw some large spark. i started hearing a buzz and ventured over to it." "yes, and what was it?" "well the buzz got louder and started to sound like words, i was almost there when i could fully make it out. It was asking "how do you get to chad's gap from the bottom of alta?"

over the course of a few days, he knew it was coming, supposedly he joked around with some people about it and knew about it form the tanner video.

i would really like to call him and just talk to him about it, what his plans are, but i doubt he would be willing to talk about it, and i dont want this to get any worse

What this genius doesn't know is that in order to make out a criminal conspiracy there must be a criminal offense to begin with. You can't just charge someone with "conspiracy", it needs to be "conspiracy to commit murder", or "conspiracy to import a narcotic", the second one being the most commonly charged these days. He also doesn't understand the basic concept of conspiracy: the crime is centered around an AGREEMENT to carry out a criminal purpose. The agreement is the act that constitutes the offense. No one, not Doug, Schmuck, or anyone else who works for this website agreed to any plan involving calling this show, and so even if that WAS somehow a criminal conspiracy, which it's not, NS would not be a party to it. But hey, guys with radio shows make a living from talking out of their asses, so why should this be any different.

In reality, by posting peoples' phone numbers and names on his show, Mr. Smith is actually exposing himself to civil liability for any number of torts. It is reasonably foreseeable (in fact you'd probably say it's the main purpose of doing so) that posting someone's name and number for all to see will lead to people calling them and harassing them. This is in itself nuisance (which is essentially an interference with a person's ability to enjoy their private property), and may result in intentional (here, reckless, which amounts to the same thing) infliction of mental suffering. So, no, no one's going to jail... but if Mr. Smith doesn't watch himself he may end up getting sued.

Learn from this, kiddies... amateur lawyering gets you into a lot more trouble than you'd think.
