5'th amendment and school

i read this on another forum and thought it was pretty good, so this isnt my idea, but i think he is right.
- by law you have to attend school
- at school, you have no rights, and can be searched and stuff
- by law we are forced to go to a place with no rights
- What happened to the 5th amendment? the right not to incriminate yourself? I would not be incriminating myself, if I weren't forced to be here, right? is there some loop hole i'm missing? Is the law allowing illegal searches?
doesnt really affect me, but i thought it was a good topic, so what is your opinion on it?

uhhh, i would think you live in the United States, because in Canada, they dont search us......... there are alot of school shootings in the US, and rarely in Canada.... maybe thats why.... plus, at my school, its not like a jail, we have alot of freedom, and i dont know what the fifth ammendment is... is that the decloration of independance, or the constitution?????

dude you might want to read what the 5th amendment says before you talk. " No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation." basicaly all it says is that you cant go on trial for something you have already been on trial before. it also says that you do not have to give information that would go against your case. so i dont really see how this has anything to do with not going to school. In school they arent technicaly allowed to search with out cause. but if it is suspected that you do have drugs or wepons or what ever on you i do belive that its free game for them to surch you.

ya we arent allowed to get searched in Canada but if the drug dogs come into school and smell out drugs then your free game

in the eyes of the law, the school acts as your parents when your in class...anything your parents can do, they can do...

umm the only reason they can search our lockers is because the lockers we use belong to the school. and im pretty sure theyre not allowed to search your pockets and what not with out probable cause.

if you are a minor you have no rights ;) Schools are allowed to search your locker because its their property, not yours. schools can search your car because most schools have you sign a piece of paper saying they have the right to. otherwise they are allowed to search you for weapons because its in the saftey of others. otherwise they need cause to search you

i pled the fifth against a sub we had this year. she asked our groups to give her our names so she could get us in trouble. i pled the fifth, worked very well.

you're only required to attend school up until around middle school. by then, i guess the govt. assumes you can make rational decisions by then.

hit the nail on the head. you are not technically a full fledged US citizen until you are 18 years old. therefore you are not entitled to the rights of the constitution.

You don't have to attend school. I just stopped going to school one day. Nothing happened to me.
