Subject: ON3P received demand to change name of “Great Scott”

This post is meant to inform anyone who has to date purchased a “Great Scott” ski from ON3P, or those who are considering a future purchase.  In late October, ON3P received a cease and desist order from SCOTT USA Ltd., and its affiliates SCOTT Sports SA and SCOTT USA Inc., demanding ON3P immediately cease commercialization and sales of all “Great Scott” branded skis for reasons of  trademark infringement. 

We are current exploring the legality of the use of “Scott” in the name of our ski “Great Scott” and should reach a decision in the near future.

Once we have reached a decision, I will post an update on the matter.

i can see why this is happening though.  as skiing is becoming more popular and new companies are forming, there is more competition for business. 

regardless, the only scott item i have ever owned was a pair of mtx goggles and now i plan not to ever use their products again.

Dear Scott USA,

It is to my understanding that you are demanding ON3P skis to change the name of their one ski, "Great Scott" because it has the name Scott in it. That ski is not meant to have any relation to Scott USA, it is in fact named after the founder of ON3P, Scott Andrus. It is ridiculous that you are doing this right after gaining all this new respect for signing Tom Wallisch. Until Scott USA drops this case leaving ON3P alone I will purchase or support nothing having to do with Scott. I really hope you take this Email seriously and put it into consideration. Thanks.

In fact, going further, you can't even register a personal name as a trademark under normal circumstances for precisely this reason: the legal system doesn't want people to be able to go around suing other people for operating under their own name, which is exactly what Scott is doing here. Honestly they could not have less of a case here and I say that based on my own legal knowledge. Of course that doesn't matter because iggyskier has just enough to scrape by and feed himself while making you guys your skis, and can't afford to defend this action, so of course the big company will once again get its way.

What a fucking piss off.

I can see how someone might be thrown off if a shop sold the "Great Scott" and "Scott" skis. And thats somewhat a valid concern.

I mean if you made a ski called Great Armada......you might draw a conclusion its even....greater then Armada...right? Just put yourself in a gapers shoes and what he / she might think.

wow, you would think they would learn from WME. its funny that they would do this now and undoubtedly loose a large portion of the freeskiing market that they would have otherwise gained by signing wallisch.

Well obviously Tom Wallisch has nothing to do with the operational decisions made by the company, he's just a member of the team, so it has almost nothing to do with him, aside from being an interesting situation given that he was closely involved with L1P as well.

Stuff like this plays a huge part in which companies I buy from and which ones I don't.  I'm seeing a trend: the big corporate multinationals get greedy and try to fuck over the underground / grassroots /  independent / start-ups.  Aka the real progressive companies that are COMPLETELY ORIGINAL (and they always get sued for "not being original (different) enough".  It's just a bunch of Bullshit, companies don't realize how much credibility they are losing with people who actually realize what's going on.

You don't know the product you are buying enough to differentiate them?  I mean who sells ON3P skis that also sells Scotts: NOBODY!!  It's a completely different market, completely different product, and Scott is the name of a person (the owner of ON3P nonetheless).  Shit's whack, no rational thought behind it.

Ya, for real, then again, by assuming their customers are even smart enough (at least about the ski industry) to know about ON3P, they are assuming too much haha.  Most of their customers probably don't.  I don't really think of Scott as a ski company, more like an "everything else company,"  do they even make pow skis??

Scott USA please... For a long time I haven't touched your product. Your skis on the rack at the store used to be a joke and just because you got some flash in your new marketing campaign stupid corporate moves like this cease and desist order won't win you any favor in our niche market. Unlike are uninformed parents generation when shopping for products news in our generation spreads like wildfire.
And for what's it's worth aluminum poles are low tech.

As a consumer I feel it's important to be behind the products I use. In a market flooded with options you just made my decisions as a consumer a little easier. P.S. I was digging your goggles

I'll add is that my personal boycott of Salomon hard and soft goods is going on 8+ Seasons strong now due to bad customers service in the warranty department.

I view this as absolute absurdity and can not justify supporting SCOTT anymore. I enjoy your skis but am not willing to funnel my money toward a company that will ultimately damage the ski industry and the smaller ski manufacturers within it. Furthermore, I can not understand how ON3P's naming of the "Great Scott" ski is damaging your brand. I am, however, hoping to hear back with your point of view on the matter.

Has nothing been learned from the Warren Miller Entertainment vs. Level 1 Productions lawsuit?    Please reconsider you actions against ON3P skis.

It's gonna go to some clueless customer service person, they won't know who Level 1 or WME are.  Best hope is that it gets passed on to somebody important.  Who realizes our concern.
